Chatman, County Probation Officer Costa of 131,W 3 DATE: January17, 2006 - o `, a Yt SUBJECT: Fifth Annual Report on the Juvenile Justice Crime oSrA csUtz� County Prevention Act Probation Department Programs SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION 164 RECOMMENDATION: Accept the fifth annual report on the County Probation Department programs funded through the Juvenile Justice Crime Prevention Act (JJCPA). BACKGROUND: The statutes governing the Juvenile Justice Crime Prevention Act funds requires in Section 30061(4)(E)(i) of the Government Code that each county shall annually report to the County Board of Supervisors and the Board of Corrections on outcome measures and expenditures for programs approved in the comprehensive multi-agency juvenile justice plans. The penalty for failure to report the required data is forfeiture of subsequent allocations from the fund. EXECUTIVE SUMMARY: The Contra Costa County Probation Department is submitting its Annual JJCPA report for the period of July 1, 2004 through June 30, 2005. Within the,context of that report is a summary of the five (5) programs, hereby listed, with data elements and outcome measures. These programs consist of: Community Probation, School- Based Deputy Probation Officers-Middle land High School Programs, Orin Allen Youth Rehabilitation Facility Aftercare Program, and The Summit Center. A perusal of the report indicates positive data outcome measures regarding recidivism rates, except for The Summit Center. The evaluators, Mark Morris and Associates (M.M.A.), provided this information. In reviewing this report by the County Probation Officer, the outcome measures under the JJCPA program for Contra Costa County and an explanation I of the outcome measures for The Summit Center must be interpreted regarding recidivism. Mark Morris collected and interpreted data for all programs under the Juvenile Justice Crime Prevention Act. The County Probation Officer is not challenging M.M.A.'s findings nor stating that their information is incorrect. However, within)the contents of the report, Mark Morris Associates indicate that all of the Summit Center participants (100%) were arrested during the follow-up (six months) evaluation for the reporting period from July 1, 2004 through June 30, 2005. Furthermore, the report states that most of the arrests were for violation of probation (75%) and the remainder for misdemeanor violations (25%). More importantly, none were arrested for violent offenses during this period of program evaluation. The County Probation Officer reflects that the recidivism rate is only those participants who committed a new law violation, which is reflected in the 25% of those individuals that committed misdemeanor offenses. Probation violations are not viewed as new arrests Ior added to our numbers as recidivism. The County Probation Officer would be remiss to state otherwise. Probation violations occur when a minor has not abided by the terms and conditions of probation as set by the j 6 venile court. These are technical violations that are brought to the juvenile court's attention by way of a notice of violation/petition being filed. Probation violations can range from a minor not attending school, disobeying a court-ordered curfew, failing drug/alcohol testing, and failure to follow the directions of the assigned deputy probation officer. Although the County Probation Officer prefers that our violation rate drop, he is satisfied that Ithe deputy probation officer is providing appropriate supervision that intervenes before the minor engages in further criminal behavior. If not for Probation's intervention, the recidivism rate would reflect a higher percentage of participant's involvement in new law violations.
