SUBJECT: Adopt Resolution approving a Notice of Intention to Convey County-owned real property identified
as APN 056-120-034, located at the northeast corner of Lone Tree Way and Heidorn Ranch Road to

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommended Action:
A. ADOPT a resolution approving a Notice of Intention to Convey County-owned real property located at the
northeast corner of Lone Tree Way and Heidom Ranch Road in Antioch,to Liberty Union High School District
(LUHSD) for $198,600.00 as described in the attached Notice of Intention to Convey Real Property in
accordance with the terms and conditions of the Purchase and Sale Agreement between Contra Costa County
and LUHSD to be on file in the Public
Works Department.
B. DIRECT the Clerk of the Board of Supervisors to have the above Notice of Intention to Convey Real Property
published one time, at least one week,preceding the date set for the Board meeting in the Contra Costa Times
(pursuant to Government Code Section 6061).
Financial Impact:
Revenue in the amount of$198,600.00 from the sale of the County-owned real property located at the northeast corner
of Lone Tree Way and Heidom Ranch Road,Antioch,wiLdepositZneral Fund.

SUBJECT: Adopt Resolution approving a Notice of Intention to Convey County-owned real property identified
as APN 056-120-034, located at the northeast corner of Lone Tree Way and Heidorn Ranch Road,
Antioch.

Reasons for Recommendations and Background:
In 1960, the County acquired title to the real I roperty located at the northeast corner of Lone Tree Way and Heidom
Ranch Road from the Lone Tree School Distnct for use by the County Superintendent of Schools for a program for
mentally challenged children. In April 1971, the County Board of Education resolved that it no longer had a need for
the Lone Tree School property. The property was not offered for sale at that time because it did not meet the minimum
land use or zoning requirements. The property was rezoned and the County sent letters of interest to other government
agencies. LUHSD responded to the County's letter stating they were interested in purchasing the property.
This property is no longer required for County use and LUHSD intends to use the property for classroom facilities.
In addition to the purchase price of$198,600,100, the property is encumbered with the "Sand-Creek - Lone Tree Way
Special Benefits District" levy in the amount($159,924.07 that LUHSD will be responsible for.
A condition of the Purchase and Sale Agreement requires that if LUHSD sells the Property for more than the
purchase price within two (2) years of recordation of the grant deed, LUHSD agrees to pay the County one-half('/z)
of the difference between the sale price and the purchase price. If, within two (2) years from recordation of the grant
deed, the LUHSD exchanges the Property for other property and cash, LUHSD agrees to pay the County one-half
('/z) of the cash compensation.
The Board previously approved a Notice of Negative Declaration on Environmental Significance [PR72-65] which was
filed with the County Clerk on July 5, 1973 and this Notice is still applicable to the conveyance of the property to
LUHSD.
Consequences of Negative Action:
The County will still own the property and have to pay the "Sand-Creek - Lone Tree Way Special Benefits District"
levy of$159,924.07.

The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Board intends to convey to Lib Irty Union High School District(LUHSD)County-owned real property
identified as Assessor's Parcel Number 0561 120-064, formerly Assessor's Parcel Number 054-230-001, located at
the northeast coiner of Lone Tree Way and Heidorn Ranch Road in Antioch,for$198,600.00,in accordance with the
terms and conditions of the Purchase and Sale Agreement between Contra Costa County and LUHSD to be on file in
the Public Works Department. The Board previously approved a Notice of Negative Declaration on Environmental
Significance[PR72-65],which was filed with the County Clerk on July 5, 1973,and this Notice is still applicable to
the conveyance of the property to LUHSD.
This Board hereby sets Tuesday, February 7, 2006 at 9:30 a.m. in the Board's Chambers in the County
Administration Building, 651 Pine Street, Martinez, California, as the time and place it will meet to consummate
this conveyance by a four-fifths vote.
The Clerk of this Board is hereby DIRECTED to have the attached Notice of Intention to Convey Real
Property published one time, at least one week preceding the date set for hearing in the Contra Costa Times, a
newspaper of general circulation(pursuant to Government Code Section 6061).
