ACCEPT reports on the 2005 second and third quarter statistics compiled by the Affirmative Action Office ori the Small Business Enterprise (SBE) and Outreach Programs. 2. MODIFY the SBE Program to exempt the following specialized purchasing transactions: ■ Medical laboratory equipment and chemicals ■ Maintenance agreements for medical equipment ■ Rental of medical equipment ■ Specialized outside patient care services ■ Hazardous medical waste disposal services ■ Medical journals and subscriptions 3. DIRECT the Health, ealth Services Director to report independently to the Internal Operations Committee in March 2006 on 2005 performance under the SBE Program for all transactions under $50,000. The program covers construction contracts of $25,000 or less, purchasing transactions of $50,000 or less, and professional/personal services contracts of$50,000 or less. For those contracts and transactions that are not exempt from the program, 50% of the dollar amount will be awarded to small businesses, as defined in the program. The Board directed the County Administrator to work with County departments to implement the program and referred the program to the Internal Operations Committee for continuing policy oversight and development of recommendations for program changes, in warranted. The Outreach Program was adopted by the Board of Supervisors in August 1998 to promote broad outreach to all businesses, currently including minority-owned, women-owned, disabled veteran-owned, small, local, and 'other businesses, and applies to service contracts in the amount of$2,500 or more and p l rchasing contracts that exceed $10,000. The IOC has provided policy oversight on the programs since their inception, including surveying County departments on the implementation of the SBE and Outreach Programs. We find that most county departments are actively participating in the programs and meeting program goals. The Affirmative Action Officer sent letters after the second quarter results were posted to those departments not fully complying with the programs or meeting program objectives. Responses from those departments are included in the attached packets. The IOC will also send follow-up letters to those departments who are not fully complying with the programs or effectively meeting program objectives as indicated by the third quarter results. The IOC recognizes that for certain categories of purchases and services for the Health Services Department, SBE Progrjam goals cannot be achieved due to the specialized nature of the transactions and the limited number of providers of those goods and services. We, therefore, recommend that the SBE Program be modified to exempt those transactions, as specified in our recommendations, from the SBE Program. The justification for such exemptions is provided in the attached memorandum dated November 16, 2005 from the Health Services Department to the Internal Operations Committee.
