CIRCLE, CONCORD FOR THE HEALTH SERVICES

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION
1. APPROVE a Lease Amendment to the Lease dated September 25, 2001 with the Holmgren
Partnership for the premises at 2355 Stanwell Circle, Concord, to add a six month cancellation
clause to the lease as requested by the Health Services Department (Health Services), under
the terms and conditions more particularly set forth in the Lease Amendment.
2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the Lease
Amendment.
FINANCIAL IMPACT
No financial impact. However, there is the potential to save rent should Health Services exercise the
cancellation clause before the end of the two year lease term.
BACKGROUND
The Lease amendment will provide a cancellation clause to enable Health Services to terminate the
lease upon six month notice to theI Lessor to facilitate possible relocation to another site. At the
direction of Health Services, the Real Estate Services Division of the General Services Department is
currently searching for suitable clinic space along the Monument Boulevard corridor to provide a
more centralized location to improve service delivery for Health Services clients.

Subject: 2355 Stanwell Circle, Concord (T00090) -Lease Amendment
I have requested and obtained approval from the Lessor for an amendment to the cancellation clause
in the current Iease whereby the County has the ability to terminate the lease should the clinic move to
another site or close entirely due to lack of funding. Health Services wants to be able to terminate the
lease should they find another location more suitable along the Monument corridor.
We have looked for such a spotwith negative results. We don't anticipate we'll find a site anytime
soon. However, as long as the landlord is willing to allow us to terminate with six months notice, I'd
like to put it in the lease just in case.
Please review the attached draft amendment and comment. I'd like to amend this clause as soon as
possible so we can exercise the next extension.
I've attached a copy of the current lease for your reference. Thanks.

FIRST AMENDMENT TO LEASE
2355 STANWELL CIRCLE
CONCORD, CALIFORNIA
FOR THE
CONTRA COSTACOUNTY HEALTH SERVICES DEPARTMENT
1. PARTIES: Effective on JAN 10 2006 THE HOLMGREN
PARTNERSHIP, hereinafte called "LESSOR", and the COUNTY OF CONTRA
COSTA, a political subdivision of the State of California, hereinafter called "COUNTY",
mutually agree and promise as follows:
2. PURPOSE: The parties desire to amend that lease ("Lease") entered into
between LESSOR and COUNTY dated September 25, 2001 for 2355 Stanwell Circle,
Concord, California, to amen the existing cancellation clause in the Lease.
3. AMENDMENT:
A. Paragraph C.6. CANCELLATION shall be deleted in its entirety and
replaced with the following:
C.6. CANCELLATION: In the event the COUNTY is unable to occupy
the Premises or prevented from fully utilizing the Premises for its primary
purpose as a medical and public health clinic due to the enforcement of
Airport Clear one restrictions or Airport related health and safety factors

or the COUNTY decides to relocate or close the medical and public health
clinic for any reason, the COUNTY shall have the right to terminate this
Lease on six months (6) months prior written notice to LESSOR.
4. EFFECT: Except for the Amendment agreed to herein, the Lease dated
September 25, 2001, remains in full force and effect.
