TO PROVIDE CONSTRUCTION MANAGEMENT SERVICES FOR THE BUILDING
PROJECT AT 255 GLACIER DRIVE, MARTINEZ, FOR THE PUBLIC WORKS

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. FIND, on the basis of the Public Works Building Expansion Mitigated Negative Declaration and all
comments received, that there is no substantial evidence that the project will have_a significant effect on
the environment.
2. ADOPT the Mitigated Negative Declaration and Mitigation Monitoring Program in compliance with the
California Environmental Quality Aci<
3. DIRECT the Public Works Director to arrange for the Fish and Game filing fee (approximately $1,250) to
be paid to the County Clerk.
4. DIRECT the Community Develop ient Department to post the Notice of Determination with the County
Clerk.
5. APPROVE a Consulting Services Agreement dated January 10, 2006 through November 10, 2007 with
Swinerton Builders ("Swinerton") 'in the amount of $603,675 to provide construction management
services for the Public Works Department Building Expansion Project, 255 Glacier Drive, Martinez.
6. AUTHORIZE the Director of General Services, or designee, to execute the agreement and to issue
written authorizations for extra work provided that the cumulative total extra cost for all such
authorizations shall not exceed $25,000.
FINANCIAL IMPACT
The project will be funded with $1.5 million from Public Works and approximately $4.2 million from a future
bond issue. The Public Works funds will be used to pay for the construction management services.

BACKGROUND
Project Description
The project involves constructing an approximately 12,100 square foot building adjacent to the Public Works
Department's current facility at 255 Glacier Drive in Martinez. The new building will address current
overcrowding and integrate staff currently located in three nearby modular buildings and an off-site office. The
County's childcare facility, which is also located in a nearby modular building, will be included in the new
building.
CEQA Process
A Mitigated Negative Declarat ient for this project was jointly prepared by the Public Works
Department and the Community Development Department. The document was circulated for the required
public review and comment period. The public review and comment period started on November 18, 2005,
and ended on December 19, 2005. A few comments were received. The comments and responses to those
comments are appended to the Mitigated Negative Declaration document. The comments did not result in any
significant changes to the document and there is no substantial evidence that the project will have a significant
effect on the environment. The project will be subject to a Mitigation Monitoring Program administered by the
Community Development Department, which is the custodian for the program.
Proiect Approach
On October 26, 2004, the Board authorized the General Services Director, when appropriate, to employ
alternative project delivery methods such as "Construction Manager At-Risk" ("CM At-Risk") to shorten project
delivery timeframes, provide improved cost control, better allocate risk, and enhance project collaboration. The
General Services Department is proposing to utilize the CM At-Risk project delivery method in implementing
the building project for the Public Works Department.
The CM At-Risk project delivery method involves concurrently and separately contracting with both an
architectural firm and a construction management firm. With the CM At-Risk method, the construction
manager ("CM") provides estimating, scheduling, value engineering, and construction market analysis services
during the pre-construction phase. During the construction phase, the CM will provide construction
management services, such as managing the various trade contractors. The CM will have financial
responsibility (i.e., they are "at-risk") for delivering the project for an agreed-upon cost and schedule, which
helps to ensure their stake in a project's success. In addition, County policies and procedures related to
outreach and project labor agreements will be incorporated into the CM At-Risk approach as the County
solicits bids from various trade contractors and awards contracts for the project construction work.
Recent and Current Efforts
On July 12, 2005, the Board awarded the architectural services contract for the design of the building addition
to Shah Kawasaki Architects ("SKA"), Oakland. SKA has completed the programming and the preliminary and
schematic design phases, and has commenced the design development phase. Thus far, one community
meeting has been conducted and information concerning the project was shared with the fourteen community
members present. I
For the CM At-Risk method to be effective, the CM must be on-board at about the same time as the architect.
The CM, the architect, and the County will work as a team to address the issues of schedule, budget,
materials, and quality. The CM will coordinate with the architect to determine how best to divide the project
into different, and phased, bid packages to fast-track the project if desired.
The General Services Department conducted a competitive selection process to hire a CM At-Risk firm.
Swinerton Builders was ranked the highest. Swinerton has a local office in Concord and their regional office is
in Oakland. Their corporate office is located in San Francisco. Contract terms for providing comprehensive
CM At-Risk services were successfully negotiated, and staff recommends approval of the consulting services
agreement.
