[CDD CP# 04-51] Oakley Area. District V DATE: January 10, 2006 PAGE: 2 Reasons for Recommendations and Backuound: The Board previously approved the granting of a new easement to PG&E in Detention Basin 52D because Diablo Water District (DWD) required PG&E to relocate their facilities from the existing easement area to a new easement area in order for DWD to install a water pipeline to service Subdivisions 8678, 8679 and 8680. After PG&E relocated their facilities from the easement area, they were required to quit claim any and all rights to the vacated easement to the District. The Board previously determined the project to be in compliance with the California Environmental Quality Act (CEQA) on February 8, 2005 {CDD CP#04-51]. Consequences of Nesative Action: PG&E will still have rights to the easement on District property. FV. Please check and respond. Emelda L.
