Barry, AICP, Director of Community Development DATE: February 28, 2006 SUBJECT: Amendment to Design and Construction Agreement, Pleasant Hill Bay Area Rapid Transit (BART) Improvements SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS APPROVE and AUTHORIZE the Redevelopment Director to execute a First Amendment to Design and Construction Agreement between Pleasant Hill Transit Village Associates, LLC, the Bay Area Rapid Transit District, and the Contra Costa County Redevelopment Agency for the implementation of Pleasant Hill BART Station improvements. FISCAL IMPACT None. No General Funds involved. The recommended action will permit improvements to proceed in a timely fashion, and create a basis for future General Funds revenues to be received earlier. The Design and Construction Agreement provided for the Agency to finance the construction of various public improvements by PHTVA, including the BART replacement parking garage. In order to permit a limited amount of "Initial Work" on the replacement parking garage to proceed in the near term, prior to execution of a master lease for the property, a First Amendment to the Design and Construction Agreement is proposed. The First Amendment will allow continued work on shop drawings, and minor modification to the existing BART parking garage to proceed in the near term, allowing project schedules to be met. Since the Agency action of December 14, 2005, the County, the Agency, BART, and the developer have executed all business agreements and an allocation of tax-exempt multi- family bond authority to finance the residential rental component of the Transit Village Project has been secured. The Board of Supervisors will be considering a resolution to allow the sale of up to$125 Million of bonds on this same February 28, 2006 agenda. The project in its many forms is progressively moving forward and the proposed First Amendment to Design & Construction Agreement will allow the progress of the project to proceed without delays.
