SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a Standard Agreement with the State of California in the amount of $22,355 to provide roadside herbicide applications along public roads within Mount Diablo State Park, and indemnify the State of California, effective February 28, 2006 through June 30, 2007. Mount Diablo area. (State Funds) (District III) FISCAL IMPACT: There will be no impact to the General Fund. The County will provide services to the State of California and the State of California will fully reimburse the County for its costs. Reasons for Recommendations and Background: The State of California must provide a fire break along public roads within Mount Diablo State Park. The County owns and operates the necessary equipment to provide this service since it provides the same service along County roads. The State of California desires to have the County provide the roadside herbicide application within the boundaries of Mount Diablo State Park. IV. Consequences of Negative Action: None. Contractor agrees to provide to the Department of Parks and Recreation (DPR) services as described herein: Provide vegetation abatement along the roadways of Mount Diablo State Park as mandated in the Mount Diablo Wildfire Management Plan. The County will provide written recommendations by a licensed pest control advisor for the level of vegetation control specified at the sites designated. The level or degree of vegetation control shall be mutually agreed upon by the State and County and shall be reflected in the recommendations of the pest control advisor. The recontinendations will include prescriptions for pre-emergent as well as contact applications as needed to control roadside vegetation. 2. The services shall be performed at: Mt. Herbicide shall be applied up to 8 feet from the edge of the roadway on Southgate, Nortingate and Summit Roads to the Juniper Campground enhance, up to 10 feet frotn the edge of the roadway at designated.locations on lower Southgate Road; and as needed and mutually agreed upon in the Mitchell Canyon and Macedo Ranch parking lots. All chemical herbicide materials shall be handled and placed by a licensed pest control applicator in accordance with product labeling and current Federal and State Regulations. All work will be perfornned consistent with all relevant laws<vid policies pertaining to environmental protection and the use ofpesdcides. The County will maintain all records regarding application of pesticides and will provide copies of those records to California State Parks upon request. Invoicing and Payment A. For services satisfactorily rendered, and upon receipt and approval of the invoices,the State agrees to compensate the Contractor for actual expenditures incurred in accordance with the rates specified in Cost Proposal marked Exhibit B, Attachment 1, which is attached hereto and-m- --- -----.....__.... ...__.. -his—Agreement _ _...._......._.. — and made a part of this Agreement. B. Budget Contingency Clause A. It is mutually agreed that if the Budget Act of the current year and/or any subsequent years covered under this Agreement does not appropriate sufficient funds for the program, this Agreement shall be of no further force and effect. In this event, the State shall have no liability to pay any funds whatsoever to Contractor or to furnish any other considerations under this Agreement and Contractor shall not be obligated to perform any provisions of this Agreement. B. If funding for any fiscal year is reduced or deleted by the Budget Act for purposes of this program, the State shall have the option.to either cancel this Agreement with no liability occurring to the State, or offer an agreement amendment to Contractor to reflect the reduced amount. 3. Prompt Payment Clause Payment will be made in accordance with, and within the time specified in, Government Code Chapter 4.5, commencing with Section 927. 4. Timely Submission of Final Invoice A. A final undisputed invoice shall be submitted for payment no more than ninety (90) calendar days following expiration or termination date of this Agreement, unless a later or alternate deadline is agreed to in writing by the project representative. Said invoice should be clearly marked "Final Invoice,"thus indicating that all payment obligations of the State under this Agreement have ceased and that no further payments are due or outstanding. B. The State may, at its discretion, choose not to honor any delinquent final invoice if the Contractor fails to obtain prior written State approval of an alternate final invoice submission deadline.
