RECOMMENDED ACTION:
APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract amendment with
Francisco & Associates, Inc., effective February 28, 2006 to increase the payment limit by $41,410 to a new
payment limit of$176,310 and extend the term from February 28,2006 to February28,2007 to provide assessment

FISCAL IMPACT:
There will be no impact to the County General Fund. The cost of the services is paid by LL-2 Landscape District
and individual zones benefiting from the services, developer fees, and the L-100 Lighting District.
REASONS FOR RECOMMENDATIONS AND BACKGROUND:
This contract extension is necessary for continuity in project delivery. The Department is experiencing increased
need for consulting services to address an unanticipated number of annexation requests and requests for formation of
new benefit zones. Additionally; work is in progress on planned assessment increase elections.
CONSEQUENCES OF NEGATIVE ACTION:
Without Board approval, there would be a negative impact to the finances of the zones within the Countywide
Landscape District, as assessments will not be levied or collected, and existing funds will not accommodate
maintenance responsibilities. Additionally new benefit zones and districts will not be formed.

Attachment A
Scope of Services
1. Certain work required to be completed in the first amendment to this contract was not completed.
The parties now wish to contract to complete this work as follows:
A. Paragraph 2), Scope of Services, Attachment A is deleted in its entirety and replaced with
the following:
"2) Benefit Zone 36 Proposition 218 Election
a. Contractor shall prepare notices, ballots, and tabulating for approximately
5,400 parcels located in Benefit Zone 36 for a proposition 218 Election.
b. Contractor shall provide assistance to property owners located in this benefit
zone."
B. Paragraph 5), Scope of Services, Attachment A is deleted in its entirety and replaced with
the following:
"5)North Richmond Community Facilities District
a. Contractor shall assist the Department of Public Works in the formation of a
Community Facilities District
b. Contractor shall prepare an auditor's report and provide assistance to property
owners within this benefit zone."
2. The Parties wish to add the following new requirements to the contract:
A. The Scope of Services, Attachment A, is amended by the addition of the following
paragraphs:
"7) Contractor will prepare an engineer's report, an auditor's report and provide property
owner assistance for Fiscal Year 2006-2007 Base Contract Contra Costa Countywide
Landscape District No. 1979-3(LL-2).
8) Contractor will prepare annexation information,prepare notices, ballots, and tabulating,
and provide property owner assistance for a Proposition 218 Election in Montalvin
Manor(approximately 610 parcels).
9) Contractor will prepare an annexation report and will prepare notices, ballot an
tabulating for new benefit zone 69 (Alamo Creek).
10) Contractor will prepare an annexation report and will prepare notices ballots, and

tabulating for new benefit zone (Color Spot).
11) Contractor will prepare an annexation report and will prepare notices, ballots and
tabulating for new benefit zone (Summerlake).
12) Contractor develop district boundary scenarios develop special tax rate scenarios and
assist with the special tax election for the Alamo Downtown Median Special Tax for
Construction.
13) Contractor will work with Department of Public Works staff to audit the current
Formation Procedures for both the Landscape and Lighting District and L-1000 and
will create a new Formation Checklist including timelines and deliverables for new
Zones. County will reimburse Contract at the hourly rates shown on (reference), not to
exceed a total of$10,000.
14) Payment for the services specified in Sections 1 through 13 will not exceed $166,310.
Upon request from the County, Contractor will provide additional services, up to the
payment limit, including, but not limited to preparation of Board Orders and
Resolutions,preparations of ballots and election language, Assessment District
calculations and modifications and other work related to Benefit Assessment Districts
and County Service Area. The scope and cost of all additional services must be agreed
to in writing by the Director of Public Works or his designee and Contractor's
authorized representative. The cost of these additional services may not exceed
$10,000.
15) Payment provisions:
a. Subject to the payment limit of this contract, Contractor will be paid for actual
time expended by Contractor's employees on this project at the following rates:
Principal Engineer $130/hr
Project Manager $110/hr
Senior Engineer $110/hr
Associate Engineer $90/hr
Senior Financial Analyst $90/hr
Financial Analyst $80/hr
CARD Designer $80/hr
CAD Operator $60/hr
Clerical $45/hr

Except as otherwise provided in subsection b, these hourly rates include
compensation for mileage and all other expenses.
b. County shall reimburse Contractor for the actual cost of mailing notices and
ballots, including duplication of envelopes, letterhead, notices and ballots and
postage."
