SUBJECT: Position Adjustment Resolution # 20118
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION : Adopt Position Adjustment Resolution # 20118 reallocating the salary of the
classification of Deputy District Attorney— Fixed Term (unrepresented).
FISCAL IMPACT : The cost associated with this action is approximately $ 67,088 annually, and will be
absorbed in the current budget of the District Attorney's Office.
BACKGROUND : The Deputy District Attorney — Fixed Term (DDA-FT) classification is the entry level
prosecutor position in the District Attorney's Office. These new attorneys handle the offices simpler
cases, primarily misdemeanors. The DDA-FT's are limited to 36 months of employment, after which they
are eligible to apply for the promotional, permanent, Merit System attorney job. This process has afforded
the District Attorney's Office greater discretion in the ability to hire only the most qualified and talented
attorneys. Additionally, this process has saved the County tens of millions of dollars by constantly
replacing fixed term attorneys with new fixed term attorneys, then promoting only the best of them to
permanent positions. To counteract the competitive disadvantage of only offering temporary employment,
a flat rate salary was created that, when this process was established almost 30 years ago, gave Contra
Costa County the highest entry salary among all Bay Area District Attorney's Offices. Over time, the
effectiveness of this process has been severely compromised by the gradual erosion of the
competitiveness of the salary.
Human Resources staff has conducted an external salary survey and determined that, although the DDA-
FT entry salary is in the range of the mean and median entry salaries, within two years of hire, DDA-FT's
are the lowest paid of any prosecutors in the Bay Area.
This salary reallocation results in the addition of one 7.5% salary increase after 18 months of employment.
RESULT OF NEGATIVE ACTION : If this action is not approved, Contra Costa County will continue to
lose DDA-FT's prior to the completion of their 3 year term due to no merit raises for three full years, thus
severely inhibiting the ability of the District Attorney's Office to hire talented permanent attorneys upon
completion of the three-year term. In the long term, this could adversely affect the quality of work within
the District Attorney's Office and pose a threat to public safety of the citizens of Contra Costa County.
