BACKGROUND / REASONS FOR RECOMMENDATION At the November 7, 2006 General Election, the voters in Contra Costa County approved Measure L the County's 2006 Voter-Approved Urban Limit Line by a 63% margin. In a separate action on December 5, 2006 the Board of Supervisors will declare and accept the certified results of the November 2006 General Election, which includes Measure L, pursuant to the Elections Code, as recommended by the County Clerk-Recorder. Contra Costa County voters in November 2004 approved Measure J, which extended Contra Costa County's Y2 percent transportation sales tax program. Measure J included a continuation of the Growth Management Program (GMP) originally approved under the transportation sales tax, known as Measure C-1988, and it carried forward six of eight compliance requirements from the existing Measure C GMP. Measure J also added a new requirement that a local jurisdiction adopt a voter- approved Urban Limit Line. A jurisdiction must have a voter-approved ULL to remain eligible to receive 18% Local Street Maintenance and Improvement Funds and 5% Transportation for Livable Communities funds under Measure J. Given-that-the Board on December 5, 2006 will formally accept the results of Measure L, the Community Development Director recommends that the Chair, Board of Supervisors, be authorized to sign and submit the attached letter to the Executive Director, Contra Costa Transportation Authority (CCTA), requesting their acknowledgement that the County's 2006 Voter-Approved Urban Limit Line (Measure L) complies with the Measure J Growth Management Program Urban Limit Line requirements. See attached draft letter under Exhibit "A" to this report. CONSEQUENCES OF NEGATIVE ACTION Failure to submit the Measure L election results to the CCTA would likely call into question the County's compliance with the CCTA's Growth Management Program and eligibility to receive 18% Local Street Maintenance and Improvement Funds and 5% Transportation for Livable Communities funds under Measure J. Through the passage of Measure L, the voters in Contra Costa County have amended the Contra Costa County General Plan (2005-2010) and the County's Land Preservation Plan Ordinance (County Ordinance Code, Chapter 82-1) to: (i) adopt a new Urban Limit Line map; (ii) extend the term of the County Urban Limit Line to the year 2026; (iii) require voter approval to expand the Urban Limit Line by more than 30 acres; and, (iv) establish new procedures to review the Urban Limit Line. At this time, the Board of Supervisors requests formal acknowledgement from the Contra Costa Transportation Authority that the passage of Measure L by voters in Contra Costa County meets the Measure J requirements for a local voter-approved Urban Limit Line and that Contra Costa County has fulfilled this requirement.
