SUBJECT: Election of Retirement Board Member Alternate
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
Adopt the attached Resolution Nu-mber 2006/744 entitled "In the matter of Election of Retirement
Board Member Number 7 Alternate".
BACKGROUND:
A vacancy has occurred in the member number 7 (alternate) seat on the Contra Costa County
Employees' Retirement Association Board due to the retirement of the incumbent Louis Kroll,
Safety Member. The attached Resolution provides for the election of a qualified individual to fill
this office for the remainder of the former incumbent's three-year term ending June 30, 2008.

NUMBER 7 ALTERNATE ) Resolution No. 2006/744
THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVES THAT:
1. The office of the following member of the Contra Costa County Employees' Retirement Association Board
has become vacant due to the retirement of the incumbent:

The safety members of the Retirement Association may elect someone to fill this office for the remainder
of the former incumbent's three-year term ending June 30, 2008, as provided below.
2. Government Code Section 31520.1 provides in part: "The alternate member shall be that candidate, if
any,for the seventh member from the group under Section 31470.2 or 31370.4,which is not represented
by a board member who received the highest number of votes of all candidates in that group." The
seventh board member is from the group under Section 31470.4 (fire suppression.) The alternate
member candidates must be from the group under Section 31470.2: "All sheriffs, under sheriffs, chief
deputies sheriff,jailers, turnkeys, deputies sheriffs, bailiffs, constables, deputies constable, motorcycle
officers, aircraft pilots, heads and assistant heads of all divisions of the office of the sheriff, detectives
and investigators in the office of the district attorney, marshals and all regularly appointed deputy
marshals are eligible.
3. Nominations shall be on forms provided by the County Clerk and filed in that office not later than 5 p.m.
on January 5, 2007. The Clerk shall have ballots printed with the nominee's names and with blank
spaces for write-in candidates. The Clerk shall have a ballot mailed no later than March 5, 2007 to each
member of the Retirement Association who are members as of February 1, 2007 with a ballot envelope in
which to enclose the ballot when voted, imprinted "Retirement Board Ballot" or similar words, together
with a "return postage guaranteed" envelope addressed to the County Clerk for mailing the ballot
envelope to that office, and with instructions that the ballot shall be marked and returned to the County
Clerk before 5 p.m. on election day. (See No. 4 below.)
4. Election Day is hereby fixed as Tuesday, April 3, 2007. Any ballot reaching the County Clerk's Office
after 5 p.m. on Tuesday, April 3, 2007 shall be voided and not counted.
5. Notice of election and nomination procedure shall be given by the Clerk by publishing a copy of this
resolution at least once in the Contra Costa Times,West Contra Costa Times, San Ramon Valley Times,
and the Ledger Post Dispatch at least ten days before the last day for receiving nominations. (See No. 3
above.)
6. On Wednesday, April 4, 2007 the County Clerk shall cause all valid ballots to be publicly opened,
counted, and tallied by an Election Board, which shall forthwith certify the return to this Board; and this
Board shall declare the winners elected, or arrange for a run-off election in case of a tie.
7. If the County Clerk receives no valid nominations for this position, he shall so inform this Board which
shall call a new election therefore; and if the Clerk receives only one nomination for this position, he shall
so notify this Board which shall declare that person elected to that position.
