FISCAL IMPACT : None. BACKGROUND : The Chief Investigator- Public Defender is a single position classification responsible for directing all investigative activities in the Public Defender's Office. All management classifications in the Public Defender's Office are exempt classifications with the exception of the Chief Investigator- Public Defender. Since this classification is a high-echelon position within the Public Defender's Office, responsible for determining and advocating substantive program policy, the Chief Investigator- Public Defender classification should also be exempt. County Counsel has amended the Ordinance as required for exempting this position. The ordinance will now supersede the previous ordinance exemptions positions from the Public Defender's Office, pending board approval. RESULT OF NEGATIVE ACTION : If this action is not approved, the Public Defender will not be able to ensure maximum responsiveness of the incumbent of this high-echelon position. Furthermore, the department's flexibility in keeping this highly important position filled will be significantly compromised. (a) The chief assistant public defender is excluded and is appointed by the public defender. (b) The chief investigator-public defender-exempt is excluded and is appointed by the public defender. (Ords. 2006-39 §1, 83-12 §1.) SECTION II: EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days of passage shall be published once with the names of the supervisors voting for and against it in the a newspaper published in this County.
