APPROVE First Amendment to the Consulting Services Agreement dated April 4, 2006 with Riedinger Consulting, which would increase the payment limit by $90,000 from $60,000 to $150,000, for additional claims analysis and litigation support services in connection with the above project. 2. AUTHORIZE the Director of General Services, or designee, to execute the amendment. FINANCIAL IMPACT The additional consulting services will be funded by project funds. BACKGROUND The 1650 Cavallo Road project was accepted as substantially complete by the Board on April 19, 2005. The project was delayed more than a year by contractor performance and payment issues. Various lawsuits were filed in connection with the project and were consolidated as one case — S & K Metal Fabricators v. Tinney Construction Corp. et al., Contra Costa County Superior Court Case No. C05-01034. To assist the County in defending against the claims filed by the contractor (Tinney) and the surety (Travelers), County Counsel solicited for claims consultant services and Riedinger Consulting (Riedinger) was selected. A Consulting Services Agreement (Agreement) was signed by Riedinger and the County effective April 4, 2006. Under the Agreement, Riedinger is providing a review and assessment of project documents and schedule and delay analyses. Because of unanticipated difficulties with the project documents and the need to prepare the case for mediation, which is scheduled for December 13, 2006, additional services are required of Riedinger. Additional services are also required to review a large volume of documents that was made available by Travelers, Tinney's bonding company. The proposed amendment also covers services for trial preparation should that be necessary. In order to properly prepare for the impending mediation, and possibly a court case, staff recommends approval of the amendment. Effective Date and Parties: Effective December 5,2006,Riedinger Consulting(herein called"Consultant"),a Sole Proprietorship,and the County of Contra Costa(herein called"County"),a political subdivision of the State of California,mutually agree as follows: 2. Pu_ ruose: On April 4, 2006, the parties entered into a contract entitled "Consulting Services Agreement," referred to as the "Agreement," which covers claims analysis and litigation support services in conjunction with the lawsuit filed on the above project. The parties desire to amend the Agreement to expand the scope of service and to increase the payment limit accordingly. 3. Amendments to Agreement: A. In the Agreement, Section 1(e), change the Payment Limit from $60,000.00 to $150,000.00, an increase of$90,000.00. This change shall apply to charges from and after August 15,2006. B. In accordance with Section 14 of the Agreement,provide the following additional services: Provide additional claims analysis and litigation support services in accordance with Consultant's attached November 7, 2006 proposal, as annotated by County,which is made a part of Appendix A to the Agreement. 4. Effect: Subject to the revisions made by this Amendment,the Agreement shall remain in full force and effect. 5.
