BARRY, AICP COMMUNITY DEVELOPMENT DIRECTOR �Q DATE: DECEMBER 5, 2006 SUBJECT: CONTRACT AMENDMENT WITH MILLS ASSOCIATES FOR NORRIS CANYON ESTATES DESIGN REVIEW SERVICES (Toll Brothers component) (Contract#C46675) (Supervisorial District III) (Amendment#4) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION APPROVE and AUTHORIZE the Community Development Director, or his designee, to execute a contract amendment with Mills Associates effective December 6, 2006 to extend the term from December 31, 2006 to December 31, 2007, with no change to the payment limit of $58,000, for providing continual services in the Norris Canyon Estates Design Review. FISCAL IMPACT None. The cost is covered by revenue received from application fees paid by developers and applicants. BACKGROUND/REASONS FOR RECOMMENDATIONS The Norris Canyon Estates project is located to the west of the City of San Ramon, and south of Norris Canyon Road. The Board of Supervisors originally approved the Norris Canyon Estates project in 1992. Approximately half of the approved 371 residential units have been built to date. Several different construction firms are developing the project, however, most of the units are being built by Toll Brothers. The County has set up an account specific to expenses that County staff encumber in the review of submittals from Toll Brothers for this project. The account addresses staff costs in the review of ministerial permit requests, annual reviews as required by the project approval, project oversight for compliance with the development permit and other applicable law, and processing of applications filed by Toll Brothers to amend the existing development permits for the Norris Canyon Estates. To assist staff in this task, the County entered into a contract with Mills Associates, a private planning consultant. The existing contract with Mills Associates extends to December 31,2006,and has an existing balance of$31,012.50. The project is not yet completed,and there is a continuing need for staff planning services that staff expects to continue to receive from Toll Brothers. To provide continuing service part of the Norris Canyon Estates project, staff recommends that the Board authorize an extension of this contract for one additional year.
