SUBJECT: FIRST AMENDMENT TOILEASE AGREEMENT BETWEEN THE HOUSING AUTHORITY
OF THE COUNTY OF CONTRA COSTA AND THE COUNTY OF CONTRA COSTA
DEPARTMENT OF GENERAL SERVICES FOR USE OF 2 CALIFORNIA STREET,

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
1. RECOMMENDED ACTION:
Acting as the Board of Supervisors, APPROVE and AUTHORIZE the Director of General Services
and acting as the Board of Commissioners of the Housing Authority of the County of Contra Costa,
AUTHORIZE and APPROVE the Executive Director to execute a lease amendment of the original Lease,
executed July 1, 1999, for the Housing Authority to provide construction and/or remodeling of the
premises for the County and County will reimburse the Housing Authority for such services as stated in
the attached Lease Amendment.
DETERMINE that the above project is a Class 1 (a) Categorical Exemption under the California
Environmental Quality Act (CEQA).
DIRECT the Director of Community Development, or designee, to file a Notice of Exemption with
the County Clerk, and DIRECT the Director of General Services, or designee, to arrange for the payment
of the handling fees to the Community Development Department and County Clerk for filing of the Notice
of Exemption.
II. FINANCIAL IMPACT:
There is no financial impact to the Housing Authority since cost for the repair/replacement of the
HVAC system will be reimbursed by the(Community Services Department.
III. REASONS FOR RECOMMENDATION/BACKGROUND
The County of Contra Costa hasl been using 2 California Street, Rodeo, CA, as a Head Start
facility operated by the County of Contra Costa. This facility and program is available to Housing
Authority, as well as the surrounding community. A Lease Agreement has been in effect since July 1,
1999. The Community Services Department (CSD) is requesting the Housing Authority to repair/replace
the HVAC system servicing the Head Start facility at 2 California Street in Rodeo. In order for the work to
be done a Lease Amendment is necessary and requires Board approval. CSD has the money set aside
for this work.

IV. CONSEQUENCES OF NEGATIVE ACTION:
Should the Board of Commissioners elect not to authorize the Executive Director of the Housing
Authority and the General Services Director of Contra Costa County to enter into a Lease Amendment the
much needed work on the HVAC system servicing the Head Start facility at 2 California Street in Rodeo
can not be done.

FIRST AMENDMENT TO LEASE
I BETWEEN
HOUSING AUTHORITY OF CONTRA COSTA COUNTY
I AND
COUNTY OF CONTRA COSTA
2 CALIFORNIA STREET, RODEO

1. PARTIES: Effective on Dec ember 19, 2006, the COUNTY OF CONTRA COSTA,
a political subdivision of the State of California, hereinafter called "COUNTY," and

the HOUSING AUTHORITY OF CONTRA COSTA COUNTY, hereinafter called
"AUTHORITY" mutually agree and promise as follows:
2. PURPOSE: The COUNTY and AUTHORITY entered into a Lease dated July 1,
1999 for the operation of a Head Start facility. The parties now desire to amend the

Lease to allow AUTHORITY Ito provide construction and/or remodeling of the
premises for COUNTY, and COUNTY will reimburse AUTHORITY for such
services.

3. AMENDMENT:
Paragraph C.6. SERVICE BY AUTHORITY, is added as follows:
C.6. SERVICE BY AUTHORITY: It is understood and agreed AUTHORITY may

provide certain construction and remodeling or like services as requested by
COUNTY from time to time during the term of this Lease, or extension thereof.
COUNTY shall pay to AUTHORITY as additional rent one hundred percent (100%)
of the actual and verifiable costs of such service.
4. AUTHORITY: This First Amendment to Lease is entered pursuant to the authority
set forth in Government Code, Section 26227.
5. EFFECT: Except for this amendment agreed to herein, the Lease of July 1, 1999,
remains in full force and effect.
