SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUST IFICATION
RECOMMENDED ACTION:
A. DETERMINE that the proposed termination of an offer of dedication will not have a significant
effect on the environment, and that it has been determined to be exempt from the California
Environmental Quality Act (CEQA) under State CEQA guidelines pursuant to Article 5, Section
15061 (b)(3),and DIRECT the Director of Community Development to file a Notice of Exemption
with the County Clerk,and DIRECT the Public Works Director to arrange for payment of a$25.00
fee to the County Clerk for filing and a$25.00 fee to Community Development for processing of the
Notice of Exemption.

Recommended Action (continued)
B. DETERMINE that this termination of an offer of dedication of a certain excess right of way not
required for pathway purposes, is made pursuant to Government Code 66477.2(c)and to Division 9,Part
3,Chapter 4 of the Streets and Highways Code,commencing with Section 8330,et. seq. A description
of the offered area to be terminated is described in Exhibit "A" and shown as "Exhibit "B"
attached hereto.
C. DETERMINE that this termination of an offer of dedication is for an excess right of way of a street or
highway not required for street or highway purposes (S&H Code Section 8334).
D. FIND there is no reasonable probability that the County will accept the offered pathway into the County
road system,that no public money has been expended for maintenance and that it is in the best interests
of the County and the public that the offered area be privately owned and maintained.
E. TERMINATE the hereinabove described offer of dedication and ABANDON the right of the County to
accept said offer. The Board is not aware of any existing in place utilities in the subject area.
F. DIRECT the Real Property Division to record a certified copy of this Board Order in the office of the
County Recorder.
G. DECLARE from and after the date this Board Order is recorded, the offer of dedication is terminated
and the County's right to accept offer is abandoned.
FISCAL IMPACT:
No fiscal impact.
REASONS FOR RECOMMENDATIONS AND BACKGROUND:
The area was dedicated to the County as a pathway being a portion of the East Richmond Heights Tract No. 2 filed
February 21, 1911 in Map Book 4 at page 9, Contra Costa County Records. The dedicated pathway is not being
used by the public. Terminating the offered right of way will allow the adjacent owner to have a reduced setback
area for development.
CONSEQUENCES OF NEGATIVE ACTION:
The setback area for the adjacent owner will not be reduced.

Real. property situated in an unincorporated area of Contra Costa County, State of
California, being a portion of the East Richmond Heights Tract No. 2, filed February
21, 1911 in Map Book 4 at page 90, described as follows:
Parcel One - Vacation
A strip of land (path) 10 feet in width as shown on said tract map (4 M 90), bounded
on the west by the easterly line of Block 97 of said map, on the north by the
southerly right of way line of Plymouth Ave, on the east by the westerly line of Block
96 of said map, and on the south by the northerly right of way line of Arlington Blvd.
Containing an area of 2,269 square feet of land, more or less.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the
Streets and Highways Code, the easement and right at any time, or from time to
time, to construct, enlarge, maintain, operate, replace, remove and renew those
existing and in place utilities, as of the date of recording this instrument, in upon,
over and across any highway or part thereof proposed to be vacated, including
access to protect the property from all hazards, in, upon, and over the area herein
before described to be vacated.

DESCRIPTION OF THE ACTIVITY:
The activity consists of the termination of an offer of dedication (approximately 10 ft. wide by
226 ft. long)adjacent to (APN 418-080-001)on Arlington Boulevard and (APN 418-080-028)on
Plymouth Avenue, in the unincorporated area of Richmond. (Fig. 2-3)
Contra Costa County (County) has determined that the offer of dedication is no longer needed
and can be terminated and conveyed to the adjacent property owners.
LOCATION:
The activity is located in west Contra Costa County in the unincorporated area of Richmond
(Fiors. 1-3).
