Project Nos.: 6X4472, 6X4482, 6X4492 (State Route 4 Bypass project, Segment 3) (District 3) (State Route 4 Bypass Funds) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the Public Works Director,or designee,to execute Amendment No. 6 to the Consulting Services Agreement with Nolte Associates Inc.effective December 12,2006 to extend the contract to December 31,2008,update Appendix B for the new wage rates for 2007,and to increase the payment limit by $100,000 to a new payment limit of$1,224,550 to provide continuing engineering services, engineering analysis for the State Route 4 Bypass project, Segment 3, Brentwood area. FISCAL IMPACT: This contract amendment allows for an additional $100,000 (100% State Route 4 Bypass Funds) above the previously amended contract for $1,124,550. The State Route 4 Bypass, Segment 3 portion is funded by the State Route 4 Bypass Authority, There is no impact to the General Fund or the Local Road Funds. Project Nos.: 6X4472, 6X4482, 6X4492 (State Route 4 Bypass project, Segment 3) (District 3) (State Route 4 Bypass Funds) DATE: December 12, 2006 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: State Route 4 Bypass, Segment 3: County Public Works Design staff has brought the project to the final level of design and the project has been awarded to a contractor by the SR4BP Authority and is currently under construction. Under this original contract, Nolte's staff has been augmenting Public Works staff by providing specific expertise and help,in order to meet the design schedule. This amendment will allow Nolte to provide continued support during the construction process over the next 2 years to further augment Public Works staff on an as needed basis. CONSEQUENCES OF NEGATIVE ACTION: If the amendment is not approved, Public Works staff will not have the on-call assistance from Nolte during the construction of the project. .. AMENDMENT No. 6 CONSULTING SERVICES AGREEMENT PROJECT NAME: State Route 4 Bypass Project, Segment 3 Project Nos.: 6X4472, 6X4482, 6X4492 1. Parties: Effective on December 12, 2006,the County of Contra Costa,a political subdivision of the State of California, hereinafter referred to as "Public Agency," and Nolte Associates Inc., hereinafter referred to as "Consultant," mutually agree and promise as follows: A. To increase contract payment limits by$100,000. $100,000 for the State Route 4 Bypass Project, Segment 3 2. Purpose: The parties desire to amend the agreement they entered into effective December 9, 2003, and amended January 20th and May 40", 2004, January 11'h 2005, and November 15, 2005 entitled "Consulting Services Agreement,"hereinafter referred to as the"Agreement." The Agreement is to provide design services, engineering analysis and recommendations for the State Route 4 Bypass Project, Segment 3 in the Brentwood area.This amendment is necessary to reimburse the Consultant for additional work beyond the original scope of work. 3. Amendment(s) to Agreement: Amend Section 1(e): Agreement Payment Limits to $1,224,550: Design Support Payment Limits to $476,000 (State Route 4 Bypass funds) Drainage / Hydrology/Hydraulics Design Payment Limits to $493,550, including contingency (State Route 4 Bypass funds) Amend Section 1(f): Extend completion date to 12/31/08 Amend Section B:,Allowing Appendix B to be updated once annually for the duration of the contract . Amend Appendix B: New Wage Rate Schedule for 2007 (attached) 4. Remaining Provisions: Except for the changes made by this Amendment, all provisions of the Agreement shall remain in full force and effect. 5.
