Diablo-SEN Labor Negotiations (REVISED) SPECIFIC REQUEST(S)OR RECOMMENDATIONS)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Formally request the John Muir/Mt. Diablo Health System, hereinafter "John Muir", and the Service Employees International Union, United Healthcare Workers West, hereinafter"SEIU",to continue to meet on a weekly basis and to bargain in good faith with one another until a contract mutually agreeable to both parties has been concluded, and that the negotiations proceed in a manner that respects the interests of community patient care and respect for the needs and views of the caregivers employed by the hospital. Direct the Chief Administrator's Office to draft and send a letter to both John Muir and SEN stating the action taken by the Board in this matter through this Order. BACKGROUND: Beginning in October of 2005,John Muir and SEN began a series of weekly bargaining sessions as part of labor negotiations to renew the contract of approximately 420 union members at SEIU. John Muir relies upon these individuals to provide services in many areas critical to patient care with responsibilities essential to the day-to-day functioning of the hospital system and to the wellness of its patients. These positions include laboratory and surgical technicians,respiratory therapists, certified nurses,housekeepers and dietary aides, among others. This has caused uncertainly for both parties,but also for those countless members of our community that use the services of John Muir. Employees have raised issues relevant to the broader community including the need to have a voice in decisions that affect patient care and safe staffing, contractual protections from arbitrary discipline, efforts to avoid layoffs and education and training programs. Management's proposal to diminish the current level of health insurance to employees has been a significant subject of contention, as has the announcement of the planned opening of a for-profit outpatient surgery center using the resources of the tax-exempt community hospital. The people of our county and those in need of medical care have long regarded John Muir as a provider of essential good quality medical care. The County must weigh in on this matter to help ensure that negotiations will progress smoothly and constructively so that the community's strong sense of reliability in the John Muir/Mt. Diablo Health System will continue to endure and that patients will continue to receive the high quality of care that they have come to expect, and that the proposals and needs workers are addressed so that they will continue to provide the care that so benefits our community. ADDENDUM TO ITEM SD.5 January 17, 2006 On this day, the Board of Supervisors considered requesting the John Muir/Mt. Diablo Health System and the Services Employees International Union, Local 250 to continue to meet weekly and bargain in good faith until a mutually agreeable contract has been concluded. Supervisor DeSaulnier introduced this item, noting John Muir/Mt. Diablo Hospital is one of the major employers in his District and an important part of the community and said he had submitted a revised Board Order. The revised Board Order adds "and that the negotiations proceed in a manner that respects the interests of community care and respect for the needs and views of the caregivers employed by the hospital." He went on to say that the negotiations affect not just the caregivers and the hospital management but severely impact the community in Central.County and the Diablo Valley. Supervisor DeSaulnier encouraged management to get back to the table and aggressively work at a satisfactory contract negotiation. Chair Gioia asked for public comment. The following people addressed the Board: Dana Simon, SEN United Healthcare Workers-West, urging the Board to take a moral stand on this and agree to help the Union during negotiations; Jack Weir, Pleasant Hill Taxpayers Association, said this is not a priority of County government and asked the Board to vote "No" vote on this proposal; Ken Hambrick, Walnut Creek resident, said it is inappropriate for the Board to tell a private enterprise how to run its labor relations. He further remarked the Board should resist this proposal and vote"No"; A letter presented to the Board from SEIU UHW, United Healthcare Worker- West with signatures from several members of the Union urging the Board to help them during negotiations. Supervisor DeSaulnier noted this issue is with a major employer and said he is against a strike. He encouraged both sides to come to an agreement and requested the Board take action to avoid a strike. Supervisor Piepho noted her intentions to abstain and said she did not notice any representatives from the John Muir/Mt. Diablo Hospital who could give any input on this proposal. She also stressed that with the County's own labor negotiations still going on, she could not support this proposal. Page—2- Addendum to D.S January 17, 2006 Chair Gioia remarked it was the Board's role to be neutral in any labor negotiation, and noted he found Supervisor DeSaulnier's goals to be neutral in that they encourage both parties to work on a timely schedule. He therefore agreed to support this proposal. Supervisor DeSaulnier said he spoke with management at Mount Diablo/John Muir, and encouraged them the same way he is trying to approach the Board to encourage both parties come to an agreement and avoid a strike. Supervisor Uilkema said she would abstain on this proposal and all issues that she believes are not a part of the jurisdiction of this Board and reiterated she would consistently apply that rule to any other proposal. Supervisor Uilkema conceded she has been troubled in the past when the Board encourages other organizations to get on with their negotiations when the County's own negotiations are still incomplete. Supervisor Glover said he is very concerned about issues that come before the Board over which the Board has no jurisdiction and requested no other such items comes before the Board until the Internal Operations Committee reviews this issue. He suggested all such matters could be referred to the Internal Operations Committee for research before coming to the Board. Supervisor Uilkema noted it would be important to show the outcome of today's discussion in the letter. She stressed she did not want the letter to use a blanket statement that "the Board of Supervisors" supported any particular course of action. Chair Gioia said he would make sure to incorporate proper characterization depicting the discussion and votes if the letter goes out.
