RECOMMENDATION:
ACKNOWLEDGE receipt of a memorandum dated October 28, 2005 from the Labor Relations
Manager regarding a petition filed by AFSCME Local 512 to Accrete Institutional Supervisor II
Classification into Probation Supervisor Unit (KU). Authorize public posting of the petition.
BACKGROUND:
In accordance with Section 34-12.015 of the County's Employer-Employee Relations Resolution
81/1165, this is to advise the Board of Supervisors that on August 17, 2005, AFSCME Local 512
filed a Petition to Accrete Institutional Supervisor II Classification into Probation Supervisor Unit
(KU). The Institutional Supervisor II classification is currently an unrepresented management
classification. Local 512 is the majority representative for the Probation Supervisor II Unit.
Proof of employee approval exceeds the minimum thirty percent (30%) requirement for qualifying
the transfer petition. In accordance with Section 34.12.016(b) (4), barring no request for
intervention by another employee organization, no election shall be required because more than
51% of the employees in the affected class to be accreted have signed Local 512 Representation
Cards.

In accordance with Section 34-12.015 of the County's Employer-Employee Relations

Probation Supervisor Unit (KU). The Institutional Supervisor II classification is currently an
unrepresented management classification. Local 512 is the majority representative for the
Probation Supervisor II unit.
Proof of employee approval exceeds the minimum thirty percent (30%) requirement for
qualifying the transfer petition. In accordance with Section 34.12.016(b) (4), barring no
request for intervention by another employee organization, no election shall be required
because more than 51% of the employees in the affected class to be transferred have signed
Local 512 Representation Cards.
Once the Board has acknowledged receipt of the petition, all other recognized
employee organization will have twenty one (21) calendar days from the date of the
Board's acknowledgement and notification, to express their intent to intervene in the
unit determination process and/or a desire to appear on a representational election
ballot or provide proof of approval from thirty (30%) of the affected employees. Upon
expiration of the twenty-one day time period, barring intervention by any other
employee organization, I will make a determination as outlined in Section 34-12.006 of
the Employer-Employee Relations Resolution.
