SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommended Action:
1. ADOPT Resolution approving the conveyance of County-owned property to Aumm Amrit,LLC;
2. DETERMINE the property to be no longer necessary by the County for highway purposes;
3. APPROVE the conveyance of said property to Aumm Amrit,LLC,pursuant to Streets and Highways
Code Section 960 and the Purchase and Sale Agreement between Contra Costa County and Aumm
Amrit, LLC;
4. AUTHORIZE the Chair, Board of Supervisors,to execute the Grant Deed and;
5. AUTHORIZE the Public Works Director, or desig ,to execute the Purchase and Sale Agreement
between Contra Costa County and Aumm Am LC on behalf of lHe County.

SUBJECT: ADOPT Resolution approving the conveyance of property to Aumm Amrit,LLC and approving the
Purchase and Sale Agreement between Contra Costa County and Aumm Amrit,LLC.

Fiscal impact:
The County will receive revenue in the amount of$300,000.00 for the sale of this surplus property,which is to be
credited to Non-County Road Construction Fund Account 4660-9921, for reimbursement to the Contra Costa
Transportation Authority(OCTA).
Reasons for Recommendations and Background;
In 1991 the County acquired Assessor Parcels Nos.098-230-047,098-230-046 and 098-230-031 for the State Route 4
Willow Pass Grade Project. The County and CCTA no longer need the remainder of these properties, which were
combined to form APN 098-230-050 for State Highway or County purposes and wish to dispose of the property. On
November 9, 2000 and April 22, 2004 the County held public auctions and received no bids. The minimum bid on
April 22,2004 was$320,000.00. A"For Sale"sign has remained on the property since the last public auction,and in
May 2005 Aumm Amrit, LLC made an offer of$300,000.00 to purchase the property. Both the County staff and
CCTA consider the offer fair and recommend the sale of the property to Aumm Amrit,LLC.
The Board reviewed and approved the project for which this parcel was purchased on September 19, 2000, and
determined the project to be exempt from the requirements of the California Environmental Quality Act(CEQA)as
a Class 12 Categorical Exemption under County Guidelines and Section 15312 of the State CEQA Guidelines. A
Notice of Exemption was filed September 21, 2000. This activity has been found to conform to the County's
General Plan.
Consequences of'Neaatiye Action:
The County would be liable of ownership,continued maintenance and it would not benefit from additional property
or sales tax revenues that the property could generate.

SUBJECT: ADOPT Resolution No. 2005/? approving the sale of surplus real property,
identified as APN 098-230-050, locatedon Evora Road, to Aumm Amrit, LLC.

The Board of Supervisors of Contra Costa County RESOLVES THAT:
Contra Costa County acquired certain real property described in Exhibit "A" attached
hereto, on January 22, 1991 in the Bay Point area with Contra Costa Transportation Authority
(OCTA) funds, for highway purposes. Said property is DETERMINED to be surplus and no
longer necessary for State Highway or other public purposes.
This Board hereby APPROVES and AUTHORIZES the sale of said property to Aumm,
Amrit, LLC, pursuant to Streets & Highways Code Section 960, and AUTHORIZES the Chair,
Board of Supervisors, to execute a Grant Deed on behalf of the County, and the Public Works
Director, or designee, to execute the Purchase and Sale Agreement between Contra Costa
County and Ammu Amrit, LLC, in consideration for the payment received in full in the amount of
$300,000.00.
The Board hereby DIRECTS that said funds be credited to the Contra Costa
Transportation Authority Fund No. 7856-9975.
The Real Property Division is DIRECTED to cause said Grant Deed and Purchase and
Sale Agreement to be delivered to the grantee.
