(District IV)' FISCAL IMPACT: None. BACKGROUND/REASON(S) FOR RECOMMENDATION(SI: The developer has entered into an agreement to secure off-site right of way and posted a cash deposit. The offsite rightof way (storm drain easement)'across property owned by the United States of America (Naval Weapons Station)has been acquired. CONSEQUENCES OF NEGATIVE ACTION: The developer will not receive'a refund of their cash deposit. Continued on Attachment. (District N) The Board on September 29, 1987, authorized the Public Works Director to execute an "Acquisition of Off Site Right of Way" Agreement with Vantage Homes, a limited partnership, developer of Subdivision 92-06889,Concord area,whereby a cash bond in the amount of$7,000.00 (Auditor's Deposit Permit No. 129575,dated September 11, 1987)was deposited as security to cover the acquisition of casts of a storm drain easement across property owned by the United States of America(Naval Weapon Station); and The Public Works Director having reported that the aforesaid storm drain easement across property owned by the United States of America (Naval Weapons Station) has been acquired and having recommended that he be authorized to refund $7,000.00, plus interest, in accordance with Government Code Section 53079,if appropriate,to Vantage Homes, a limited partnership; and It is by THE BOARD RESOLVED that the recommendation of the Public Works Director is APPROVED.
