BACKGROUND The Board of Supervisors adopted Resolution No. 2002/262 as part of the July 9,2002 approval of the Camino Tassajara Combined General Plan Amendment. The resolution included conditions of approval that required the establishment of a Livable Communities Trust Fund.The fee would apply to all units constructed within the Camino Tassajara Combined General Plan area, except for the units identified in the Camino Tassajara Affordable Housing Program. The $8,000 per unit fee was agreed to by the County, Shapell Industries, Braddock and Logan Group II, L.P. and Ponderosa Homes. The purpose of the fee is to help with the implementation of the Smart Growth Action Plan, which contains provisions designed to improve the livability of communities throughout Contra Costa County.A condition of approval (attached)was included, as part of the approval for the Alamo Creek and Intervening Properties development projects, that required payment of the$8,000 fee prior to the issuance of each residential building permit. An independent and accessible interest bearing trust account needs to be established in order maintain the Livable Communities funds. Properties Approved Conditions Prior to issuance of every building permit for any unit not subject to the Camino Tassajara Affordable Housing Program dated July 9, 2002 by and between the County of Contra Costa, Shapell Industries, Inc., Braddock and Logan Group II, L.P., and Ponderosa Homes, Inc. (hereafter "CTAHP); the applicant shall pay a "Livable Communities Fee" in the amount of$8!,000 to the Contra Costa County Livable Communities Trust. No such fee shall be due for the Alamo Creek Senior Housing and Alamo Creek Townhouses as those tern s are defined in the CTAHP and which meet the requirements of Section IV (B)(1-2) of said CTAHP. The applicant for Subdivision 8381 shall deposit $600,000 of this fee, and the applicant of Subdivision 8382 shall deposit $40,000 of this fee prior to filing the first final map of such respective subdivisions, which will then be credited against building permits for market-rate units as they are issued. After this deposit has been credited to a $0 balance, the fee shall be paid on a per unit basis prior to issuance of each further building permit.
