Project Nos.: 6X4472, 6X4482,6X4492 (State Route 4Bypass project, Segment 3) SPECIFIC REQUEST(S)'OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION: APPROVE and AUTHORIZE the Public Works Director, or designee, to execute Amendment NO. 5 to the Consulting Services Agreement with Nolte Associates Inc. effective November 1, 2005 to extend the contract to December 31,2007 and to increase the payment limit by$100,000 to a new payment limit of$1,124,550 to provide additional engineering services, engineering analysis for the State Route 4 Bypass project, Segment 3,Brentwood area. FISCAL IMPACT: This contract amendment allows for an additional $100,000 (100% State Route 4 Bypass Funds) above the previously amended contract for$1,024,550. The State Route 4 Bypass, Segment 3 portion is funded by the State Route 4 Bypass Authority. There is no impact to the General Fund or the Local Road Funds. Project Nos.: 6X4472, 6X4482, 6X4492 (State Route 4 Bypass project, Segment 3) DATE: November 15, 2005 PAGE: 2 of 2 REASONS FOR RECOMMENDATIONS AND BACKGROUND: State Route 4 Bypass,Segment 3: County Public Works Design staff has currently brought the project to the final level of design and is proceeding towards advertising the project for the SR4BP Authority in December 2005. Under this original contract,Nolte's staff has been augmenting Public Works staff by providing specific expertise and help,in order to meet the design schedule. This amendment will allow Nolte to provide additional support during the advertisement and bidding process as well as to provide construction support over the next 2 years to further augment Public Works staff on an as needed basis. Since Public Works staff intends to use Nolte staff only if necessary for design issues during the construction process, staff does not anticipate extensive amount of effort by Nolte. CONSEQUENCES OF NEGATIVE ACTION: If the`amendment is not approved, Public=Works staff will not have the on-call assistance from Nolte during advertisement and construction of the project. AMENDMENT No. 5 CONSULTING SERVICESAGREEMENT PROJECT NAME: State Route 4 Bypass Project, Segment 3 Project Nos.: 6X4472, 5X4482, 5X4492 1. Parties: Effective on November 1, 2005,the County of Contra Costa, a political subdivision of the State of California, hereinafter referred to as "Public Agency," and Nolte Associates Inc., hereinafter referred to as "Consultant," mutually agree and promise as follows: A. To increase contract payment limits by$100,000. $100,000 for the State Route 4 Bypass Project, Segment 3 2. Purpose The parties desire to amend the agreement they entered into effective December 9, 2003, and amended'January 20`" and May 41n, 2004, and January 11 to 2005 entitled "Consulting Services Agreement," hereinafter referred to as the "Agreement." The Agreement is to provide design services, engineering analysis and recommendations for the State Route 4 Bypass Project, Segment 3 in the Brentwood area.This amendment is necessary to reimburse the Consultant for additional work beyond the original scope of work. 3. Amendment(s)to Agreement: Amend Section 1(e): Agreement Payment Limits to $1,124,550: Design Support Payment Limits to $376,000 (State Route 4 Bypass funds) Drainage / Hydrology/Hydraulics Design Payment Limits to $493,550, including contingency {State Route 4 Bypass funds} Amend Section>1(f)::'Extend completion date to 12/31/07` 4.
