SPECIFIC REQUEST(S)OR RECOMMENDATIONS(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
APPROVE&AUTHORIZE the Redevelopment Director to execute a Second Amendment to Public Improvements
Design Funding Agreement with Pleasant Hill Transit Village Associates, LLC, to increase the payment limit by
$500,000 to a new payment limit of $1,500,000 for design, engineering, and related work for the BART patron
replacement parking structure, Pleasant Hill/Contra Costa Centre BART Station Area.
FISCAL IMPACT
None. No general funds are involved, The Agency has budgeted funds for the Parking Structure project. The
recommended action will allow the Agency, BART,and the developer(Pleasant Hill Transit Village Associates,LLC
formed by Millennium Partners)to continue final design work to construct a replacement parking structure beginning
in 2006. This action is a precedent step to positioning the County for general fund returns in an amount estimated in
excess of$500 million over the next 100 years.
BACKGROUND
On September 9,2003 the Board of Supervisors,acting in its capacity as the legislative body for the County,and as
the governing Board of the Redevelopment Agency, approved the establishment of a joint powers agency with the
Bay Area Rapid Transit District(BART). The JPA,the Pleasant Hill BART Station Leasing Authority,will be the legal
entity that will enter into a ground lease with the Millennium Partners development entity— Pleasant Hill Transit
Village LLC. The JPA Agreement,among other things provides for the Redevelopment Agency to pay for the costs of
the BART Replacement Parking program. In order to move this program forward in an expeditious fashion the
Agency, by its action of May 11,2004, agreed to fund preliminary design and engineering.A First Amendment was
approved on January 18,2005. This Second Amendment will allow the parties to complete the final design and for
the JPA to confirm that the costs of the parking structure will be within the range provided for in the JPA Agreement.
In order to move to construction of the BART Replacement parking Garage in early 2006 the Agency has been
requested to provide additional funding for the final design development phase. The recommended action will allow
the parking garage final design/engineering to progress in a timely fashion,
