DETERMINE that the conveyance and exchange will not have a significant effect on the environment, therefore, is exempt from the requirements of the California Environmental Quality Act (CEQA) under Section 15312 of the CEQA Guidelines. B. DIRECT the Clerk of the Board of Supervisors to have the above Notice of Intention to Convey and Exchange Real Property published one time,at least one week preceding the date set for the Board meeting in the Contra Costa Times (pursuant to Government Code Section 6061). FISCAL IMPACT: Revenue in the amount of$1,300,000.00 from the exchange of the property located at 3490 Golden Gate Way, Lafayette, and$2,800,000.00 for the conveyance of the property located at 1250 Locust St., Walnut Creek will be deposited into the General Fund. The County will also contribute up to $2,330,000.00 from the County General Fund to the Lafayette Redevelopment Agency for the construction of the new Lafayette Veterans Memorial building. REASON FOR RECOMMENDATIONS AND BACKGROUND: The County acquired the property and building located at 3490 Golden Gate Way,in Lafayette on April 8, 1963,and the property and building located at 1250 Locust St., in Walnut Creek on February 28, 1944. Each of those buildings has been used by Veterans organizations over the years. The LRDA now desires to use the 3490 Golden Gate Way property for the construction of its new library. On October 15, 2002, the County,the LRDA, the City of Lafayette, and the Lafayette War Veterans, Inc. entered into a Memorandum of Understanding (MOU)whereby the County would exchange the 3490 Golden Gate Way property to the LRDA for$1,300,000.00 for(i)the LRDA acquiring additional land at another location in Lafayette, (ii) constructing a new building on it, and (iii) conveying the new land and building to the County for use as the Lafayette Veterans Memorial Building. The MOU was then amended on July 14,2003,to include the conveyance of the 1250 Locust St.property by the County to the Walnut Creek Redevelopment Agency for$2,800,000.00,and to allow for the Walnut Creek Veterans groups to share the use of the new Lafayette Veterans Memorial building. The County has, therefore, determined that neither of the two County-owned properties is needed-for County purposes and that the property to be acquired in the exchange with LRDA is required for public use,and intends to enter into Purchase and Sale Agreements with both the LRDA and the Walnut Creek Redevelopment Agency for the conveyance of those respective properties and buildings, in accordance with the MOU. CONSEQUENCES OF NEGATIVE ACTION: The will not be in compliance with the MOU. Project No. 4308-6G5190 The Board of Supervisors of Contra Costa County RESOLVES THAT: The Board hereby FINDS that the exchange of County-owned real property identified as APN 243-231-014 located at 3490 Golden Gate Way in Lafayette with the Lafayette Redevelopment Agency for$1,300,000 and the real property identified as 3780 Mt.Diablo Blvd.in Lafayette,and the conveyance of County-owned real property identified as APN 184-060-013,located at 1250 Locust St.Walnut Creek to the Walnut Creek Redevelopment Agency for$2,800,000 will not have a significant effect on the environment; therefore, these actions are exempt from the requirements of the California Environmental Quality Act(CEQA)as a Class 12 Categorical Exemption under Section 15312 of the CEQA Guidelines. DIRECT the Director of Community Development to file a Notice of Exemption with the County Clerk,and DIRECT the Public Works Director to arrange for payment of $25.00 handling fee to the County Clerk for filing and a $25.00 fee to Community`Development for processing of the Notice of Exemption. This activity has been found to conform to the General Plans of both the cities of Lafayette and Walnut Creek. This Board intends to exchange County-owned real property more commonly known as 3490 Golden Gate Way, Lafayette (APN 243-231-014) with the Lafayette Redevelopment Agency (LRDA) for $1,300,000.00 and property owned by the LRDA more commonly known as 3780 Mt.
