Shiu, Public Works Director DATE: October 25, 2005 SUBJECT: ADOPT Resolution approving a Quitclaim Deed to Gerald Stuart Ketchum and Sharon Kay Ketchum to remove the County's interest in a vacated portion of Wellington Avenue. Clyde Area, District IV. [CDD-CP#87-71] Project No. 0676-6P1600 I. Recommended Action: ADOPT Resolution approving a Quitclaim Deed to Gerald Stuart Ketchum and Sharon Kay Ketchum in order to remove the County's interest in a vacated portion of Wellington Avenue. AUTHORIZE the Chair, Board of Supervisors, to execute the Quitclaim Deed on behalf of the County. DIRECT the Real Property Division to record a certified copy of the Resolution in the office of the County Recorder. II. Financial;Impact: None Ill. Reasons for Recommendations and Background: On October 16, 2001, the County Board of Supervisors adopted Resolution No. 478 vacating a portion of Wellington Avenue. The Applicant is requesting a quitclaim deed in order to satisfy the Community Development Department that the County no longer has an interest in the vacated portion of Wellington Avenue, and to comply with the parking requirement of 20 feet. The Board of Supervisors of Contra Costa County RESOLVES THAT: On October 16, 2001, the Board adopted Resolution No. 478, which vacated a portion of Wellington Avenue. This Board hereby DETERMINES that said land, described in Exhibit "A" and shown as Exhibit "B" attached hereto, was previously subject to a street, highway or public service easement, and is no longer needed by the public. The Board hereby determines that any County right, title and interest in said property should be quitclaimed to the adjacent owner. Pursuant to Streets and Highways Code Section 8355, the Board hereby APPROVES the quitclaim of the County's interest of said property to Gerald S. Ketchum and AUTHORIZES the Chair, Board of Supervisors, to sign the Quitclaim Deed on behalf of the County. The Real Property Division is DIRECTED to cause said deed to be delivered to grantee.
