[CP#85-55] Alamo Area. District III. Project No. 7520-6B8451 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUS-rIFICAT€ON Recommended Action: A. ADOPT a Resolution to summarily vacate an excess portion of San Ramon Creek not required for storm drain purposes located on the corner of Twelve Oaks Court and Chaney Road in the Alamo area. B. DIRECT the Real Property Division to record a certified copy of the Resolution in the office of the County Recorder. Financial IMRact: None Reasons for Recommendations and Bac round: The Flood Control and Water Conservation District (District) acquired an easement over a portion of APN 187.I10- 040 which is no longer needed for storm drain purposes. The property owner requested that the encumbrance be removed. These rights are no longer necessary for the maintenance of Sari Ramon Creek. Consequences of Neeative Action: The District may be responsible for the maintenance of s area. A description of the portion to be vacated is described in Exhibit"A"and shown on Exhibit"B"attached hereto and incorporated herein by reference. This vacation request is for a public service easement that has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the proposed vacation.
