BACKGROUND/REASON(S) FOR RECOMMENDATION(S): The developer, Shapell Industries of Northern California,a Division of Shapell Industries,Inc.,has completed the subdivision improvements per the Subdivision Agreement, and in accordance with the Title 9 of the County Ordinance Code. CONSEQUENCES OF NEGATIVE ACTION: The completion of improvements will not be accepted and the warranty period will not begin. (District IITj DATE: October 25, 2005 PAGE: 2 NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of October 25, 2005 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT NAME OF SURETY February 24, 2004 National Fire Insurance Company of Hartford BE IT FURTHER RESOLVED the payment(labor and materials)surety for$1,115,500.00, Bond No. 929 263 069 issued by the above surety be RETAINED for the six month lien guarantee period until April 25,2006, at which time the Clerk of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED that the private improvements have been COMPLETED and are NOT ACCEPTED, at this time. Upon acceptance by the Board of Supervisors, the developer, Shapell Industries of Northern California,a Division of Shapell Industries of Northern California,Inc.,shall retain the subdivision improvements for maintenance during the warranty period. BE IT FURTHER RESOLVED that there is no warranty period required, and the Public Works Directoris AUTHORIZED to refund the $22,300.00 cash security for performance (Auditor's Deposit Permit No. 413390, dated October 16, 2003)plus interest in accordance with Government Code Section 53079, if appropriate, to Shapell Industries of Northern California, pursuant to the requirements of the Ordinance Code; and the Subdivision Agreement and surety bond,Bond No.. 929 263 069, dated October 7,2003 are exonerated. All deposit permits are on file with the Public Works Department.
