RECOMMENDATION(S):
ADOPT Resolution No. 2005/ a6tC for Road Acceptance 02-01128(cross-reference Subdivision 96-08023 and
Subdivision 01-08570), accepting completion of warranty period, for project being developed by Hofmann Land
Development Company,Discovery Bay area. (District III)
FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The offsite public road improvements have met the guarantee performance standards for the warranty period
following completion and acceptance of improvements.
CONSEQUENCES OF NEGATIVE ACTION:
The billing account will not be closed and liquidated.

Adopted this Resolution on October 25, 2005 by the following vote:

RESOLUTION NO. 2005/ 4 6146
SUBJECT: Accepting completion of warranty period, Road Acceptance 02-01128 (cross-
reference Subdivision 96-08023 and Subdivision 01-08570), Discovery Bay area.
(District III)
On June 22, 2004, this Board resolved that the offsite public road improvements, Road
Acceptance 02-01128 (cross-reference Subdivision 96-08023 and Subdivision 01-08570) were
complete and that such improvements were constructed without the need for a Road Acceptance
Agreement. The improvements were secured under the Encroachment Permit EL03-17942 with a
$2,000.00 cash bond (Deposit Permit No. 411654, dated September 11, 2003 and a performance
security bond (Liberty Mutual Insurance Company Right of Way Re-Establishment bond for
$192,200.00,Bond No. 070000629,dated September 8,2003). Now on the recommendation of the
Public Works Director;
The Board hereby FINDS that the improvements have satisfactorily met the guarantee
performance standards for the period following completion and acceptance.NOW THEREFORE BE
IT RESOLVED that the warranty period has been completed. The cash bond and performance surety
bond are exonerated and refunded with the completion of Encroachment Permit EL03-17942.
