SUBJECT: Establishment of New Schedule of Fines and Charges for County Library
SPECIFIC REQUEST (S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
1. CONDUCT public hearing on proposed establishment of new schedule of fines and charges for Contra Costa
County Library.
2. RECEIVE oral and written testimony regarding the proposed increases.
3. CLOSE hearing and CONSIDER proposed increases(Attachment 1).
4. APPROVE attached Resolution 2005/42 establishing a new schedule of fines and charges for the Contra Costa
County Library.
Approve the resolution establishing new fees and charges for the County Library to include a $10.00 library materials
recovery/late charge and an $8.00 charge for missing and damaged portions of cassette tape and compact disc sets. For
kits,there will be a daily fine of$2.00 with the maximum fine of$10.00 per kit. If a kit is lost the patron will be required
to pay the replacement cost along with a$5.00 Processing Fee. We also recommend that the County Librarian may waive
the Books by Mail Fee for homebound patrons. At the conclusion of the hearing, adopt a new schedule of fines and
charges and ordinance.
FINANCIAL IMPACT:
It is estimated that these changes will recover the cost of replacing damaged or missing cassette tapes, compact discs, and
kits.
BACKGROUND:
The County Librarian is recommending changes to the library fee structure in order to cover the cost of materials recovery
and the replacement of missing portions of library materials.
On September 9, 2003 the Board of Supervisors authorized the County Librarian or the County".s Purchasing Manager to
issue a Request for Proposals to secure a firm or agency for library materials recovery services.
On February 10, 2004, the Board of Supervisors authorized the County Librarian to negotiate a contract with Unique
Management Services to provide these materials recovery services. Pending approval of the new contract, on the Board
of Supervisors agenda for January 11,2005,these services are expected to begin on February 1,2005.
On January 4,, 2005, the Board of Supervisors set January 25, 2005 as the date for a Public Hearing on the establishment
of new fees and charges for the County Library.
A copy of the proposed fines& charges was placed on file at the Clerk of the Board's Office, Room 106, 651 Pine Street,
Martinez,ten(10)days prior to the date of the hearing.
The Resolution proposed by the County Librarian incorporates five Resolutions 871260, 921559, 93/739, 97/174 and
2003/316 into one document and adds the changes mentioned above.

WHEREAS, the Contra Costa County Librarian has submitted a recommendation to amend
the schedule of itemized fines and charges to include a$10.00 library materials recovery/late
charge; an $8.00 charge for missing and damaged portions of cassette tape and compact
disc sets. For kits, there will be a daily fine of $2.00, a $10.00 per kit maximum fine, a
$10.00 per kit maximum fine pet- item, if lost, the actual replacement cost if the kit is lost,
along with a $5.00 processing fee and a $10.00 Materials/Recovery/Late Fee; and the
County Librarian may waive the Books By Mail fee for homebound patrons; and
WHEREAS, this resolution is intended to supersede Resolutions 87/260, 92/559, 93/739 and
2003/316; and
NOW, THEREFORE, BE IT RESOLVED that an amended schedule of fines and charges is
established effective February 1, 2005 as contained in Attachment 1 of this Resolution, and
that this Resolution supersedes Resolutions 87/260, 92/559, 93/739 and 2003/316.
