RECOMMENDATIONS
1. OPEN the public hearing on the proposed text amendment to incorporate Geographic
Information System (GIS) based maps into Division '84 (Zoning) of the County
Ordinance Code (see attached Exhibit "A": Draft Ordinance 2005-03).
2. CLOSE the Public Hearing.
3. ADOPT a Negative Declaration of Environmental Significance that this zoning text
amendments would not result in any significant impacts on the environment and
determine that the environmental review is adequate for consideration of the zoning
text amendments.

2.004 of the County Ordinance Code, and replaces it with new section 84-2.002 and
84-2.004, to incorporate the Zoning Map of Contra Costa County based on the
County's Geographic Information System (GIS) .

BACKGROUND/ REASON FOR RECOMMENDATION
The County Ordinance Code includes provision for how the County's official zoning maps will be
maintained in code sections 84-2.002, 84-2.003 and 84-2.004. This section was last updated in 1978
when the County converted to the Public Works Base Map system.This is a County initiated proposal
to adopt a text amendment to Division 84, Contra Costa County Zoning Ordinance Code,which would
convert the existing zoning maps from a system based upon the-1978 Public-Works Base Map series
to an electronic or digital version of zoning district boundaries using the County's GIS mapping
program.
The Community Development Department acquired a new computer-based GIS mapping program
and began the process of converting the County's official zoning district maps into an electronic file
format. GIS is a type of software that allows a .user to create an electronic file format of a map
(sometimes referred to as a digital version), and then store the map on a storage medium, such as a
hard drive or CD-ROM. Simply put, a GIS program combines layers of information about a place
providing the user with a better understanding of that place.The Community Development Department
initiated the process of converting zoning maps (paper copies) into an electronic file format — this
process is also called digitizing.The digitizing process has now been completed and the digital zoning
maps are now ready to be officially used. The change in record keeping to the electronic or digital
format under this proposal contains two actions:
1. Repeal sections 84-2.002, 84-2.003 and 84-2.004 of the County Ordinance Code (Title 8:
Zoning)which reference Zoning Maps being maintained on the Public Works Base Map series
with a new sections 84-2.002 and 84-2.004 which references zoning maps based upon the
County's Geographic Information System.
2. Acknowledge the use of the zoning maps for the unincorporated area, which were prepared
using the GIS mapping system to replace those that were maintained on the now dated 1978
Public Works Base Maps.

The shift in record keeping to the new GIS based mapping program has numerous applications
and advantages for the County, including:
a) The change from hand drawn to a digital format will improve accuracy and display greater
detail on zoning maps;
b) The digital format will provide a safer, more efficient, and cost effective approach for
storage and archival retrieval for zoning maps;
c) The digital format for zoning maps enables these maps to be linked to additional layers in
GIS mapping providing the Community Development Department's planners with a-new tool
to compare zoning with other important information that may be relevant in reviewing
development applications before the County or in conducting land use studies;
d) The digital format can be easily linked to the County's website to enable the public more direct
access to zoning information through the Internet.

ORDINANCE NO. 2005-03
ZONING MAP ADOPTED
The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes
from the official text of the enacted or amended provisions of the County Ordinance Code):
SECTION I. SUMMARY. This ordinance repeals sections 84-2.002, 84-2.003, and 84-2.004 of
the County Ordinance Code and replaces it with a new section 84-2.002 and a new section 84-2.004,
to incorporate the Zoning Map of Contra Costa County,based on the County's geographic information
system(GIS), into Division 84 of the County Ordinance Code.
SECTION II. Sections 84-2.002, 84-2.003, and 84-2.004 of the County Ordinance Code are
repealed in their entirety and are replaced by new Section 84-2.002 and new Section 84-2.004, added
by Section III of this ordinance.
SECTION III. Sections 84-2.002 and 84-2.004 are added to the County Ordinance Code,to read:
84-2.002 Zoning Map adopted.
(a) The location and boundaries of the land use districts established by this division are shown on a
map entitled"Zoning Map of Contra Costa County." The Zoning Map, including symbols,.
boundaries, notations, legends, and all other information shown on the Zoning Map, is adopted
by this reference and incorporated into this division. This adoption of the Zoning Map does not
change the land use classification of any land.
(b) The Zoning Map, certified by the community development director, is on file with the clerk of
the board of supervisors. A paper version and a digital version of the Zoning Map are available
for public inspection at the community development department.
(c) a gWhen zoning ordinance or amendment to a zoning ordinance changes any property from one
zone to another,the community development director will record the change on the Zoning
Map. All changes so recorded are made a part of the Zoning Map and incorporated into this
division.
(d) If the boundaries of a land use district are not clearly identifiable on the Zoning Map, the
following rules of interpretation apply:
(1) Where a boundary line appears to follow a street, highway, or right-of-way, the
boundary is deemed to be the centerline of the street, highway, or right-of-way.

(2) Where a boundary line appears to follow a lot line or property line, the boundary is
deemed to be the lot line or property line.
(3) Where a boundary line appears to divide a lot or parcel, the location of the boundary is
determined by the scale contained on the Zoning Map.
(4) Where there is an obvious mistake that can be corrected by reference to documents on
file with the community development department, or where there is a minor discrepancy
between the paper version and the digital version of the Zoning Map, the community
development director may identify the boundary.
(5) If any further uncertainty exists, the planning commission will determine the location of
boundaries. (Ords. 2005-03 § 35 78-93: prior code § 8140: Ord. 382.)
84-2.004 Districts established. The use of all land in the unincorporated territory of this county,
within the districts shown on the Zoning Map described in this chapter, is subject to the provisions of
this Division 84. Land is classified for the regulation of its use as set forth in this division. The land use
districts set forth in this division are established for all this territory, and the land use districts designated
on the Zoning Map adopted by Section 84-2.002 are established and classified in this division. (Ords.

SECTION IV. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and
within 15 days after passage shall be published once with the names of supervisors voting for or against
it in the Contra Costa Times, a newspaper published in this County.

RESOLUTION OF THE COUNTY PLANNING COMMISSION OF THE COUNTY OF
CONTRA COSTA, STATE OF CALIFORNIA, RECOMMENDATIONS ON THE ON
COUNTY INITIATED TEXT AMENDMENTS TO MODIFY COUNTY CODE CHAPTERS
84-2.0029 84-2.003 AND 84-2.004,AND REPLACING WITH NEW SECTION 84-2.002 AND
84-2.0049 TO USE COMPUTER-BASED GIS MAPPING SYSTEM FOR THE
PREPARATION AND STORAGE OF COUNTY ZONING MAPS(COUNTY FILE:ZT#04-
0003), COUNTYWIDE
WHEREAS,zoning districts were first established in the unincorporated area of Contra Costa
County in the late 1940's by resolution with an accompanying findings map to delineate the district;
and
WHEREAS, in the mid-1970's Contra Costa County embarked on a program to improve
zoning maps by updating and transferring maps prepared since the 1940's to a mapping system
created under Contra Costa County Public Works Base Map series; and
WHEREAS,in October 1978 the Board of Supervisors adopted an ordinance establishing the
1978 County Public Works Base Maps as the official zoning maps for Contra Costa County(Ord.
78-93); and
WHEREAS, in 2000 the Contra Costa County Community Development Department
acquired a new computer-based Geographic Information System mapping program and began the
process of converting the County's zoning maps into an electronic file format, a process more
commonly known as creating a digital map.
WHEREAS, after notice was lawfully given, a public hearing was scheduled before the
County Planning Commission on Tuesday,December 21,2004,whereas all persons interested might
appear and be heard; and
WHEREAS, on Tuesday,December,2004,the County Planning Commission having fully
reviewed, considered, and evaluated all the testimony and evidence submitted in this matter; and
WHEREAS,for the purposes of compliance with the California Environmental Quality Act
(CEQA),the Community Development Department on November 19,2004 issued a Notice of Public
Review and Intent to Adopt a Negative Declaration of Environmental Significance and an Initial
Study on the proposed General Plan reconsolidation and the proposed Negative Declaration was
posted and noticed as required by law; and,
NOW,THEREFORE,BE IT RESOLVED that County Planning Commission of the County
of Contra Costa recommends for adoption to the Board of Supervisors of the County of Contra Costa
the text amendments as described in the December 21,2004 staff report and recommendations to the
County Planning Commission, which will repeal sections 84-2.002, 84-2.003 and 84-2.004 of the
County Ordinance Code,which reference zoning maps being maintained on the Public Works Base
Map series, and replaces with a new sections 84-2.002 and 84-2.004 that references zoning maps
based upon the County's Geographic Information System (GIS).

BE IT FURTHER RESOLVED,that County Planning Commission of the County of Contra
Costa recommends the Board of Supervisors of the County of Contra Costa acknowledge the GIS
created zoning maps as the replacement for those that M* the past were maintained on the Public
Works base map set.
BE IT FURTHER RESOLVED that the Secretary of the County Planning Commission shall
respectively sign and attest the certified copy of this resolution and deliver the same to the Board of
Supervisors all in accordance with the Planning Laws of the State of California.

I. INTRODUCTION
CONTRA COSTA COUNTY INITIATED ADOPTION OF GIS VERSION OF
ZONING MAPS, County File: ZT#04-0003. This is a County initiated proposal
to convert the existing zoning maps from a system based upon the Public Works
Base Maps to an electronic version of the zoning district boundaries using the
technology of the County's new Geographic Information System (GIS) mapping
program. The change in record keeping format contains two actions:
A. Repeal sections 84-2.002, 84-2.003 and 84-2.004 of the County Ordinance
Code (Title 8: Zoning) which reference Zoning Maps being maintained on
the Public Works Base Map series with a new sections 84-2.002 and 84-
2.004 which references zoning maps based upon the County's Geographic
Information System.
B. Acknowledge the use of the zoning maps for the unincorporated area,
which were prepared using the GIS mapping system to replace those that
were maintained on the now dated Public Works Base Maps.
II. JURISDICTION OF THE COMMISSION
While rezoning issues fall within the jurisdiction of all three Planning
Commissions, this zoning ordinance text change is being brought to the County
Planning Commission since this is a project that is countywide in scope as
specified by the ordinance establishing the Commissions and the Board of
Supervisors implementation decisions. Sole jurisdiction to make a
recommendation is vested with the County Planning Commission.
This is a text amendment whose purpose is to create a new official digital zoning
file and not to cause a rezoning of property.
III. CEQA DETERMINATION
A proposed Negative Declaration/Initial Study has been prepared for this project
and was issued on November 19, 2004. The proposed Negative Declaration/Initial
Study determined that the modification to the County Ordinance Code, repealing
Sections 84-2.002, 84-2.003, and 84-2.004 and replacing with new Section 84-
2.002 and new Section 84-2.004, to use a computer-based GIS mapping program

for the preparation and storage of County zoning maps, .would not result in any
actions that would directly or indirectly impact the physical environment.
IV. BACKGROUND ON COUNTY ZONING MAPS
The initial establishment of zoning districts in Contra Costa County occurred in
the late 1940's and the effort to zone the County gained momentum during the
1950's. The zoning districts were adopted by resolution with an accompanying
findings map to delineate the district. The findings map was published in the
newspaper and it was codified through an official zoning map signed by the
Planning Director (now designated as the Community Development Director).
When there would be an amendment to the zoning district approved by the Board
of Supervisors it would be adopted through a revised zoning map. During the
period from the late 1940's through the 1950's much of the County was rural and
generally speaking the mapping resources were primitive by today's standards.
Maps were manually drawn and oftentimes maps were prepared on different
scales, sometimes making it difficult to interpret and reproduce. In the mid-1970's
the County embarked on a program.to improve the zoning maps by updating and
transferring to a new mapping system created under County Public Works
Department Base Maps. This mapping system, which was formally adopted by
the County in 1978,is the system that is in current use today.
V. GIS AND DIGITIZED ZONING MAPS
In 2000 the Community Development Department acquired a new computer-
based Geographic Information System (GIS) mapping program and began the
process of converting the hardcopy of zoning maps into an electronic file format.
GIS is a type of software that allows a user to create an electronic file format of a
map (sometimes referred to as a digital version), and then store the map on a
storage medium. Simply put, a GIS program combines layers of information
about a place to give you a better understanding of that place. The Cornmunity
Development Department initiated the process of converting zoning maps (which
are essentially paper copies) into an electronic file format, this process is more
commonly referred to as digitizing of maps. The digitizing process has now been
completed and the digital zoning maps are ready to be officially used.

VI. ACTIONS REQUIRED TO CONVERT TO THE NEW SYSTEM
A. Adopt Replacement Ordinance
The County Ordinance Code includes provision for how the official
zoning maps will be maintained in code sections 84-2.002, 84-2.003 and
84-2.004. This section was last updated in 1978 when the County
converted to the Public Works Base Map system. See Attachment A, the
December 7, 1978 report from the Planning Director to the Board of
Supervisors explaining the new zoning map system and the accompanying
ordinance adopting the new maps. Similar in nature to the action taken in
1978, County Counsel office has drafted a new ordinance to replace these
sections 84-2.002, 84-2.003 and 84-2.004. See Attachment B. It should
be emphasized that as the geographic information becomes more detailed
and sophisticated that zone boundaries do not always perfectly line up
with street or parcel lines, if the user zooms in the maximum extent
possible. The draft ordinance provides rules to assist interpretation where
that circumstance might occur.
B. Acknowledgement of the GIS Generated Maps.
In 1978 the County adopted by ordinance a "new" set of zoning maps
based upon a Public Works base map approach using 300' and 1000' base
maps. Prior to that time zoning maps were adopted at varying scales and
base maps depending on what map resources were available. The 1978
Public Works Base Maps were a major advance for its time. As the Public
Works Base maps became more accurate and detailed, the ability to more
precisely map zoning districts has increased throughout the developed
portions of the County. With the County converting its base mapping to
the even more sophisticated GIS format, the opportunity to use that new
technology for maintaining the zoning maps opened up. As a logical
extension of the GIS mapping effort, the conversion to the electronic
version of the zoning map is desirable.
Staff recommends the Board acknowledge the GIS created zoning maps as
the replacement for those that in the past were maintained on the Public
Works base map set.

C. Certification of Maps
The Director of Comrniunity Development should continue providing
certification of a paper copy of the zoning maps. The draft ordinance (see
Attachment B) provides both a paper and a digital version of the zoning
maps that will be available for public inspection at the Community
Development Department and also provides that zoning changes are to be
recorded by the Co �umunity Development Director on the zoning maps.
D. Public Availability of the Maps
Upon adoption,the zoning maps should be made available to the public on
the Department's webpage (located within the County's website). The
website will indicate that these maps constitute the official Zoning district
boundaries for the unincorporated area. This will be maintained up to date
for use of the public. These maps can also be downloaded to a storage
medium such as a CD-ROM (compact disc-read only memory), and made
available to the public.
VII. RECOMMENDATIONS
Recommend the Board of Supervisors take the following actions:
A. Repeal Sections 84-2.002, 84-2.003 and 84-2.004 of the County
Ordinance Code and replace it with a new Section 84-2.002 and a new
Section 84-2.004 to incorporate the Zoning Map of Contra Costa County,
based on the County's Geographic Information System (GIS), into
Division 84 of the County Ordinance Code (Title 8: Zoning). This
ordinance change references the GIS maps that will replace the 1978 Map
system based upon the prior Public Works Department Base Map set.
B. Acknowledge the GIS created Zoning Maps as a replacement for the
zoning maps currently maintained upon the Public Works Base Map
system.
C. Have the GIS maps certified by the Director of Community Development
as being the official Zoning Maps of the County and make a paper copy of

those maps and placed on file at the Clerk of the Board and County
Community Development Department offices.
D. Place the GIS version of the official zoning maps on the County's website
and regularly maintain it for public access and use, and download these
maps to a storage medium, such as a CD-ROM, for storage and make it
available to the public.

ORDINANCE NO. 2004- PLANNING COMMISSION DRAFT
ZONING MAP ADOPTED
The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes
from the official text of the enacted or amended provisions of the County Ordinance Code):
SECTION I. SUMMARY. This ordinance repeals sections 84-2.002, 84-2.003, and 84-2.004 of
the County Ordinance Code and replaces it with a new section 84-2.002 and a new section 84-2.004,
to incorporate the Zoning Map of Contra Costa County, based on the County's geographic information
system(GIS), into Division 84 of the County Ordinance Code.
SECTION H. Sections 84-2.002,, 84-2.003, and 84-2.004 of the County Ordinance Code are
repealed in their entirety and are replaced by new Section 84-2-002 and new Section 84-2.004, added
by Section M of this ordinance.
SECTION III. Sections 84-2.002 and 84-2.004 are added to the County Ordinance Code, to read:
84-2.002 Zoning Map adopted..
(a) The location and boundaries of the land use districts established by this division are shown on a
map entitled"Zoning Map of Contra Costa County." The Zoning Map, including symbols,
boundaries,notations, legends,and all other information shown on the Zoning Map,is adopted
by this reference and incorporated into this division. This adoption of the Zoning Map does not
change the land use classification of any land.
(b) The Zoning Map, certified by the community development director, is on file with the clerk of
the board of supervisors. A paper version and a digital version of the Zoning Map are available
for public inspection at the co nunity development department.
(c) When a zoning ordinance or amendment to a zoning ordinance changes any property from one
zone to another,the community development director will record the change on the Zoning
Map. All changes so recorded are made a part of the Zoning Map and incorporated into this
division.
(d) If the boundaries of a land use district are not clearly identifiable on the Zoning Map,the
following rules of interpretation apply:
(1) Where a boundary line appears to follow a street,highway, or right-of-way, the
boundary is deemed to be the centerline of the street, highway, or right-of-way.

(2) Where a boundary line appears to follow a lot line or property line, the boundary is
deemed to be the lot line or property line.
(3) Where a boundary line appears to divide a lot or parcel,the location of the boundary is
determined by the scale contained on the Zoning Map.
(4) where there is an obvious mistake that can be corrected by reference to documents on
file with the community development department, or where there is a minor discrepancy
between the paper version and the digital version of the Zoning Map, the community
development director may identify the boundary.
(5) If any further uncertainty exists, the planning commission will detennine the location of

84-2.004 Districts established. The use of all land in the unincorporated territory of this coup

districts set forth in this division are established for all this territory, and the land use districts designated

SECTION IV. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and
