Approval and.Adoption of the 2005 FCCIP will provide a planning and programming document that programs funds for capital flood control improvement projects throughout the County in the next seven years. REASONS FOR RECOMMENDATIONS AND BACKGROUND: The Contra Costa County Flood Control and Water Conservation District(District)has established seventy-three Flood Control Zones(FCZ)and Drainage Areas(DA)for the construction,operation and/or maintenance of storm drainage improvements. A plan of improvement has been defined for each FCZ and DA. However, no comprehensive planning document has been prepared to guide the development and orderly implementation of planned improvements throughout the County. The proposed 2005 FCCIP is the first such document. The 2005 FCCIP is intended to reflect the policies set forth in the Flood Control District Expenditure Policy (Expenditure Policy) that is currently under consideration by the Transportation, Water and Infrastructure (TWT) Committee. The Expenditure Policy was circulated extensively for public comment prior to its introduction to the TWT Committee on November 8,2004.The District has sent the Expenditure Policy with a request for comments to the Mayors,the Managers and the City Engineers of all the cities in the County. However,it is anticipated that the Expenditure Policy will not be finalized for consideration by the Board of Supervisors prior to the end of February 2005. At the same time,the County and its cities,acting as the Contra Costa Clean Water Program(CCCWP),are taking actions necessary to comply with the Section C3 requirements of the National Pollutant Discharge Elimination System (NPDES) permit that was amended by the San Francisco Bay Regional Water Quality Control`Board (RWQCB) in 2003. The amended permit requires that projects approved after February 15, 2005, that create impervious surfaces or disturb more than one acre,must capture and treat storm water before its release from the project area.These requirements will significantly increase the cost ofboth private and public projects.The CCCWP has indicated that public projects approved as a program of capital improvements prior to February 15,2005,may not be subject to the new NPDES requirements. Thus, adopting a seven-year program of capital improvements provides the opportunity for considerable relief from the C3 requirements. Therefore, it is recommended that the Board of Supervisors adopt the proposed 2005 FCCIP on an interim basis. The 2005 FCCIP will be amended, as necessary, to reflect the Expenditure Policy when it is ultimately adopted by the Board. Approval of the FCCIP by the Board does not automatically approve each individual project listed in the FCCIP. Each project must undergo its own public review, engineering feasibility analysis and environmental assessment before the Board of Supervisors will consider its approval. As this is a planning level document, adoption of the FCCIP will not preclude construction of projects that have not been identified. However, projects added to the FCCIP will be subject to the amended C3 requirements of our NPDES permit. Adopting a FCCIP to guide the implementation of our capital improvements will do several things for the District: — Increase public awareness of how and where funds will be spent on our storm drainage system. — Enhance the District's public image and public trust by showing that funds are programmed in detail and will SUBJECT: Flood Control Capital Improvement Program, Countywide DATE: January 18, 2005 PAGE: 3 of 3 be expended in accordance with a well considered program. — Encourage more public involvement in the programming and expenditure of our capital funds. — Provide more "accountability" for meeting acceptable levels of service. — Provide a basis for projecting staffing needs over the next seven years. — Provide a budget tool to track expenditures of the various types of funding utilized for capital improvements. On December 13, 2004, the TWI Committee reviewed the 2005 FCCIP for fiscal years 2005-2006 through 2011- 2012 and recommended its approval and adoption on an interim basis while the proposed Expenditure Policy is reviewed by the cities. The TWI Committee further recommends that the Expenditure Policy,once it is approved by the Board, guide future updates to the FCCIP. The Expenditure Policy will be scheduled before the Board separately. CONSEQUENCES OF NEGATIVE ACTION: Failure to approve the 2005 FCCIP may subject the District to increased costs to implement the Section C3 requirements of the NPDES permit and will eliminate the opportunity for guidance from a comprehensive planning document. The TWI Committee, consisting of Supervisors Uilkema and Greenberg, approved the report with final comments at its December 13, 2004 meeting. Staff subsequently finalized the report in preparation for its submittal to the full Board of Supervisors in January 2005. In the interim, Supervisor Greenberg's term of-service ended, and she was not available to sign the report. However, Supervisor Uilkema has signed the report.
