FISCAL IMPACT No General Fund.impact. HOME and CDBG funds are provided to the County on a formula allocation basis through the U.S.Department of Housing and Urban Development(HUD).The additional$25,000 in funds will come from administrative and project funds currently allocated to the HOME and CDBG programs. BACKGROUNDIREASONS FOR RECOMMENDATIONS Centra Costa County receives an annual allocation of approximately$5 million in federal CDBG and HOME funds for use in developing housing affordable to lower income households in the County. Typically, the County's funds are provided as part of a structured financing with deeds of trust and specific affordability and use restrictions incorporated into loan and regulatory agreements.In addition, approximately $500,000 in CDBG funds is used for economic development projects which involve structured financings. The law firm of Goldfarb and Lipman provides the County with legal assistance in negotiating loan terms and preparing the required legal documents. A significantly higher level of activity than anticipated has occurred this year, which will deplete the original$40,000 contract amount with Goldfarb and Lipman.The proposed amendment to increase the maximum payment limit under the contract by $25,000 to a maximum of$65,000 will be adequate to ensure the provision of legal services required to meet the needs of the CDBG and HOME programs through the remainder of this fiscal year. \\€s-cd\users$\kdouglas\kdouglas\Ivew\Board Orders\2004\GFBudget.doc Contra TO: BOARD OF SUPERVISORS FROM: David Coleman, Public Defender Costa DATE: December 14, 2004C o u n ty cflut= SUBJECT: PUBLIC DEFENDER- DEPENDENCY CASE ASSISTANT 0. 5� SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RIGINAL RECOMMENDATION: APPROVE and AUTHORIZE the Public Defender to execute a contract with Charles Grant in an amountnot to exceed $43,500 to continue to provide Dependency Case Assistance for the period January 2, 2005 through December 31, 2005. FISCAL IMPACT Estimate no impact on the General Fund. The cost of dependency case services is reimbursed 100% by the Superior Court under California Rules of Court, rule 810, which identifies the cost eligible for the Trial Court Funding Program. BACKGROUND/REASON(S) FOR RECOMMENDATION(S): Attorneys assigned to represent minors in dependency cases are obligated by state law to visit the minor clients in the homes and placement settings at least once every 6 months. Such "home visits" may also entail consultations with families or other professionals such as social workers, teachers and psychologists. The home/school visits provide information from and consultation with the minor child that, in turn, form the basis for advocacy on behalf of the dependent'children clients in W & 1 300 proceedings. Dependency Case Assistants (DCA) work with, and under the supervision of, attorneys in the Public Defender's Office assigned to handle Welfare and Institutions Code Section 300 cases for minors in Juvenile Court. (1) attorneys are paid more on an hourly basis than contract DCAs and such home visits involve travel time and other scheduling duties which can be carried out by DCAs at a lower hourly cost; and (2) DCAs often have backgrounds in social work, child development, education, criminal justice, and other allied fields which gives them an expertise not necessarily possessed by attorneys in the Public Defender's Office. The tasks of the DCA often require work on weekends and in the evenings and sometimes at locations that require lengthy automobile trips. Given the alternative and irregular work schedules required, as well as other work experience characteristics of the DCAs, recruitment, retention and payment as contract employees works best for the Department. Hopefully, too, in the best interests of continuity in their interaction with younger minors, a bond of trust will be established with these clients. RECOMMENDED ACTION: APPROVE and AUTHORIZE the County's Chief Information Officer or his designee to execute on behalf of the County an agreement amendment with the Soft Link Solutions, Inc. for assistance with the upgrade of PeopleSoft extending the period from March 31, 2005 through June 30,2005 and increasing the payment limit from $813,000 to $1,044,500. 11. FISCAL IMPACT: None. Funding for this project is provided by the PeopleSoft project III. REASONS FOR RECON MFNDATION AND BACKGROUND: In March 1996 the Board of Supervisors approved the acquisition of PeopleSoft as the replacement for the County's Human Resources,Payroll and Employee Benefits systems.The contract with Soft link will provide the resources to assist the County with the upgrade of PeopleSoft to the latest release. This upgrade is necessary to provide the County with current information necessary to properly process employee personnel, tax and benefit information. Currently the County is running on an unsupported release of the product. Soft Link was selected though the competitive bid process. IV. CONSEQUENCES OF NEGATIVE ACTION. If this contract is not approved the County will be delayed in completing the upgrade. FISCAL IMPACT: None. All costs will be reimbursed by the State of California Weatherization Program. BACKGROUND/REASONS FOR RECOMMENDATIONS: The Department' s goal is to utilize all the grant funds that have been made available to the County. Grant funds are provided by the State' s Energy program. Maximizing the utilization of available funds would help improve the quality of dwellings in Contra Costa County. These funds are targeted to low-income residents, in order to help lower their energy expenses . Specifically, the funds are used to install energy efficient hot water heaters, heaters, refrigerators, microwaves, florescent light bulbs, weather-- stripping, attic insulation, switch and plug gaskets, water heater blankets, and perform post weatherization lead testing. In order to increase the production level and maximize utilization of these available funds, the Department decided to increase its use of outside contractors. This necessitates increased and continued use of the services provided by Environmental Lead Detection, Inc. Environmental Lead Detection is one of the few companies doing contract work for the State Weatherization Program. FISCAL IMPACT None to County General Funds. The Contra Costa Centre Association's Child Care Subsidy Program is funded by developer contributions. Contributions have been made by most of the property owners in the Pleasant Hill BART Station Area. Contributions are held by the County in a designated trust fund. Via Redevelopment Contra Costa Centre Association BY � �' - ' , DEPUTY G:\CDBG-RED&V\redev\LNoble\personal\Board orders and Greenies\BOSCCCA.childcare.2004-2005.1.05.dcc BACKGROUND/REASONS FOR RECOMMENDATIONS Can August 13, 1991, the Board of Supervisors approved Child Care Mitigation Agreements with various property owners in the Pleasant Hill BART Station Area, approved a Child Care Program Administration Agreement with the Contra Costa Centre Association. The combination of these two agreements provided for a monetary contribution on the part of the property owners for childcare mitigation, and for the Contra Costa Centre Association to undertake a Child Care Subsidy Program with the interest earnings on said funds. Funds could also be used for capital contributions to childcare projects that would increase the amount of available childcare space that serves the Pleasant Hill BART Station Area. Contra Costa Centre Association has prepared a Child Care Subsidy Program. The program provides for a subsidy payment to the qualified employees to offset a portion of their childcare costs. The Contra Costa Centre Association anticipates subsidizing onlythose families whose incomes fall below$54,000 annually. Childcare costs would be reimbursed on a sliding scale. Thirty-one families currently participate in the program. The program budget allows approximately 35 participant families. On average, the families pay $150.00 per week for childcare expenses.
