SUBJECT: ADOPT Resolution No. 2005/ 69 approving the Quitclaim. Deeds from Contra Costa County
Flood Control and Water Conservation District to Laferty Homes at Deer Ridge, California Sun

exchange for a replacement flowage easement from Fairways at Deer Creek and the City of

The Board of Supervisors of Contra Costa County,as the governing body of the Contra Costa County Flood
Control and Water Conservation District RESOLVES THAT:
Contra Costa County Flood Control and Water Conservation District acquired certain real property by
Easement Deed, filed in Book 427 of Maps at Page 29 on August 28, 1964 as described in Exhibit "A" attached
hereto. Said interest is DETERMINED to be no longer necessary for the District.
This Board hereby APPROVES and AUTHORIZES the conveyance of said interests to Laferty Homes at
Deer Ridge, California Sun Properties, Western Pacific Dousing, Fairways at beer Creek, and the City of
Brentwood, pursuant to Government Code Section 2552.6.5, and the Chair, Board of Supervisors, is hereby
AUTHORIZED to execute Quitclaim.Deeds on behalf ofthe District,in consideration for ACCEPTING Grants of
Easements from Fairways at Deer Creek, and the City of Brentwood for a replacement flowage easement in
accordance with changes to elevations and contours that reflect the current conditions to meet the needs for Dry
Creek Reservoir.
The Board of Supervisors adopted the City of Brentwood's Final Environmental Impact Report on April 27,
2004 in support of such Real Property Transactions,

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. ADOPT Resolution approving the Quitclaim Deeds from Contra Costa County Flood Control and
Water Conservation District (District) to Laferty Homes at Deer Ridge, California Sun Properties,
Western Pacific Housing, Fairways at Deer Creek and the City of Brentwood in connection with
Subdivision 8310.
B. APPROVE the conveyance of said property from the District,pursuant to Government Code § 25526.5
and AUTHORIZE the Chair, Board of Supervisors, to execute the Quitclaims Deeds on behalf of the
District,
C. DIRECT the Real Property Division to cause said Quitclaim Deeds to be delivered to the Grantees for
acceptance and recording.
D. ACCEPT the Grant of Easements from Fairways at Deer Creek dated October 14, 2004 and from the
City of Brentwood dated December 17, 2004 and DIRECT the Real Property Division to have said
easements recorded in the Office of the County Recorder.

III. Reasons for Recommendations and background:
California sun Properties is developing a residential golf community. To accommodate the development the
existing flowage easement acquired on August 28, 1964 as shown in the final reap for subdivision 8310 has
been altered. In order to reflect current conditions as a result of the development, the District needs to
exchange the existing flowage easement for a new flowage easement, which reflects the actual Reservoir
conditions today. The result of the exchange of flowage easements will allow the District to continue the same
volume and capacity as the previous flowage easement. On April 27,2004,the Contra Costa County Board of
Supervisors adopted the City of Brentwood's Final Environmental Impact Report for the purposes of
conducting Real Property transactions with regards to Subdivision 8310.
IV. Consequences of Ne%ative Action:
On August 28, 1964 the District acquired a flowage easement. Due to changes with elevations and contours
due to the new subdivision, the current flowage easement does not meet the needs for Dry Creek Reservoir.
This exchange of easements is to revise and reflect the current conditions to the new elevations and contours.

APPROVING THE FOLLOWING ACTIONS: (1) ACCEPTING GRANT OF
EASEMENTS FROM CONTRA COSTA COUNTY FLOOD CONTROL DISTRICT FOR
STORM DRAINAGE EASEMENTS AND SPY GLASS DRIVE IN SUBDIVISION NO.
8310, (2) ACCEPTING A QUITCLAIM DEED FROM CONTRA COSTA COUNTY
FLOOD CONTROL. DISTRICT FOR A PREVIOUS FLOWAGE EASEMENT IN
SUBDIVISION NO. 8310, (3) ACCEPTING A GRANT DEED FOR A WETLAND AREA

WHEREAS, on January 19, 1993, by Resolution No. 93-2, Planning Commission
approved `Jesting Tentative Subdivision Map No. 7690 by A.G. Spanos Construction Company,
Inc., for the development of up to 1,031 residential units and an 18-hole golf course (Brentwood
Hills Country Club Project), with conditions; and
WHEREAS, on April 7, 1998, by Amended Resolution No. 93-2, Planning Commission
approved a 1-year extension of Vesting Tentative Subdivision Map No. 76190 by A.C. Spanos
Construction Company, Inc., for the development of up to 1,031 residential units and an 18-hole
golf course (Brentwood Hills Country Club Project), with amended conditions; and
WHEREAS, on January 12, 1999, by Resolution No. 99-18, City Council approved Final
Map of Subdivision No. 7690 Beer Creek Country Club, accepting the offers of dedication
shown thereon subject to acceptance of improvements, accepting the improvement security,
approving the Subdivision improvement Agreement, and authorizing the Mayor and City Clerk to
execute the same; and
WHEREAS, on October 10, 2000, by Resolution No. 2170, City Council approved the
Final Map of Subdivision No. 8310 beer Ridge Village Lots being a Subdivision of the
Remainder, Common Area "E" Mountain View Drive, and Ranchwood Drive, as shown on that
certain Final Map entitled "Subdivision No. 7690 Deer Creek Country Club" (SunCal), located
south of Balfour Road and west of Concord Avenue, accepting the offers of Dedication shown
thereon subject to acceptance of improvements, accepting the improvement security, approving
the Subdivision Improvement Agreement, and authorizing the Mayor and City Clerk to execute
the same; and
WHEREAS, real property generally located west of Concord Avenue and south of
Balfour Road in the City of Brentwood, is needed for flood control purposes, constructing a
portion of Spyglass Drive and for the wetlands in Subdivision No. 8310; and

WHEREAS, Grant of Easements, a Quitclaim Deed and a Grant Deed between the City
of Brentwood and Contra Costa County Flood Control have been developed and are necessary
to transfer properties respectively.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Brentwood
that a Resolution approving the following actions: (1) accepting Grant of Easements from
Contra Costa County Flood Control District for storm drainage easements and Spy Glass Drive
in Subdivision No. 8310, (2) accepting a Quitclaim Deed from Contra Costa County Flood
Control District for a previous flowage easement in Subdivision No. 8310, (3) accepting a Grant
Deed for a wetland area in Subdivision No. 8310, generally located west of Concord Avenue
and south of Balfour Road, hereby accepting all or the above real property on behalf of the City,
and authorizing the Mayor or City Manager and City Clerk or any of their designees to execute
the Grant of Easements, and such other documents as may be needed to complete the
transaction; (4) authorizing the Mayor or City Manager and City Clerk or any of their designees
to execute Grant of Easements to Contra Costa County Flood Control in Subdivision No. 8310,
hereby conveying a portion of real property for replacement of flowage easements and to
provide County access for maintenance of their facilities and such other documents as may be
needed to complete the transaction.
BE IT FURTHER RESOLVED, that the City of Brentwood hereby accepts the real
property described in the Grant of Easements, Quitclaim Deed and Grant Deed.

GRANT OF EASEMENT
THIS INDENTURE, made by and between Fairways at Deer Creek, LLC, a Delaware limited
liability company, hereinafter called the GRANTOR, and CONTRA COSTA COUNTY FLOOD
CONTROL. AND WATER CONSERVATION DISTRICT, a political subdivision of the Sate of
California, hereinafter called the GRANTEE,
WITNESSETH:
That the GRANTOR,for value received,hereby grants to the GRANTEE a permanent easement
for flowage and storage of runoff waters over and upon all the lands lying within an area having
as its perimeter the 166 feet elevation above sea level contour. The area of which is more
specifically described below.
RESERVING to the GRANTOR,their successors and assigns,the right and privilege to use said
land described for any purpose not inconsistent with, or that will not interfere with:, the full use
and enjoyment by the GRANTEE or its successors and assigns, of the rights and privileges
herein granted.
Further, GRANTOR and their successors and assigns agree not to alter the ground surface as
constructed or remove any drainage facilities or improvements within said easement area orto
construct any above-ground improvements without the prior written consent of the GRANTEE
across that certain real property in the County of Contra Costa, State of California, described as
follows:
FOR DESCRIPTION SEE PARCELS "A", "B", "E", "F", AND "G" of EXHIBIT "A",
ATTACHED HERETO AND MADE A PART HEREOF,
The easement herein granted shall include the right by said GRANTEE, its officers, agents and
employees, and by persons under contract with it and their employees whenever and wherever
necessary for flood control purposes, to enter upon said land with personnel, vehicles and
equipment,to remove all trees,vegetation and structures thereon that interfere with the purpose
for which the easement herein is granted.
It is understood that GRANTEE shall have no responsibility for the protection, maintenance,
damage to,or removal of GRANTOR'S facilities, appurtenances or improvements, caused by or
resulting from GRANTEE'S use of the property or work or operation thereon, it is the sole
responsibility of the GRANTOR to provide and maintain adequate protection and surface
markings for its own facilities within the area described in Exhibit A as Parcels"A", "B" "E","F„
and "G" herein.
It is understood that GRANTEE shall have no responsibility for the protection, maintenance,

GRANT OF EASEMENT
THIS INDENTURE,made by and between the City of Brentwood, a municipal corporation of the State
of California, hereinafter called the GRANTOR, and CONTRA COSTA COUNTY FLOOD CONTROL
AND WATER CONSERVATION DISTRICT, a political subdivision of the Sate of California,hereinafter
called the GRANTEE,
WITNESSETH:
That the GRANTOR, for value received, hereby grants to the GRANTEE a permanent easement for
flowage and storage of runoff waters over and upon all the lands lying within an area having as its
perimeter the 166 feet elevation above sea level contour. The area of which is more specifically
described below.
RESERVING to the GRANTOR,their successors and assigns,the right and privilege to use said land
described for any purpose not inconsistent with, or that will not interfere with, the full use and
enjoyment by the GRANTEE or its successors and assigns, of the rights and privileges herein
granted.
Further, GRANTOR and their successors and assigns agree not to alter the ground surface as
constructed or remove any drainage facilities or improvements within said easement area or to
construct any above-ground improvements without the prior written consent of the GRANTEE across
that certain real property in the County of Contra Costa, State of California, described as follows:
FOR DESCRIPTION SEE PARCEL "C"and "D" of EXHIBIT "A" ATTACHES? HERETO AND
MADE A PART HEREOF.
The easement herein granted shall include the right by said GRANTEE, its officers, agents and
employees, and by persons under contract with it and their employees whenever and wherever
necessary for flood control purposes, to enter upon said land with personnel,vehicles and equipment,
to remove all trees, vegetation and structures thereon that interfere with the purpose for which the
easement herein is granted.
It is understood that GRANTEE shall have no responsibility for the protection, maintenance, damage
to, or removal of GRANTOR'S facilities, appurtenances or improvements,caused by or resulting from
GRANTEE'S use of the property or work or operation thereon. It is the sole responsibility of the
GRANTOR to provide and maintain adequate protection and surface markings for its own facilities
within the area described in Exhibit A as Parcels "C" and "D" herein.
TO HAVE AND TO HOLD, all and singular, the rights above described unto the GRANTEE and the
GRANTEE'S successors and assigns forever.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD,
APPROVING THE FOLLOWING ACTIONS: (1) ACCEPTING GRANT OF
EASEMENTS FROM CONTRA COSTA COUNTY FLOOD CONTROL'DISTRICT FOR
STORM DRAINAGE EASEMENTS AND SPY GLASS DRIVE IN SUBDIVISION NO.
8310, (2) ACCEPTING A QUITCLAIM DEED FROM CONTRA COSTA COUNTY
FLOOD CONTROL DISTRICT FOR A PREVIOUS FLOWAGE EASEMENT IN
SUBDIVISION NO. 8310, (3) ACCEPTING A GRANT DEED FOR A WETLAND AREA
IN SUBDIVISION NO. 8310, GENERALLY LOCATED WEST OF CONCORD AVENUE
AND SOUTH OF BALFOUR ROAD, HEREBY ACCEPTING ALL OR THE ABOVE
REAL PROPERTY ON BEHALF OF THE CITY, AND AUTHORIZING THE MAYOR OR
CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE
THE GRANT OF EASEMENTS, AND SUCH OTHER DOCUMENTS AS MAY BE
NEEDED TO COMPLETE THE TRANSACTION; (4) AUTHORIZING THE MAYOR OR
CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE
GRANT OF EASEMENTS TO CONTRA COSTA COUNTY FLOOD CONTROL IN
SUBDIVISION NO. 8310, HEREBY CONVEYING A PORTION OF REAL PROPERTY
FOR REPLACEMENT OF FLOWAGE EASEMENTS AND TO PROVIDE COUNTY
ACCESS FOR MAINTENANCE OF THEIR FACILITIES AND SUCH OTHER
DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION.
WHEREAS, on January 19, 1993, by Resolution No. 93-2, Planning Commission
approved Vesting Tentative Subdivision Map No. 7690 by A.G. Spanos Construction Company,
Inc., for the development of up to 1,031 residential units and an 18-hole golf course (Brentwood
Hills Country Club Project), with conditions; and
WHEREAS, on April 7, 1998, by Amended Resolution No. 93-2, Planning Commission
approved a 1-year extension of Vesting Tentative Subdivision Map No. 7690 by A.G. Spanos
Construction Company, Inc., for the development of up to 1,031 residential units and an 18-hole
golf course (Brentwood Hills Country Club Project), with amended conditions; and
WHEREAS, on January 12, 1999, by Resolution No. 99-18, City Council approved Final
Map of Subdivision No. 7690 Deer Creek Country Club, accepting the offers of dedication
shown thereon subject to acceptance of improvements, accepting the improvement security,
approving the Subdivision Improvement Agreement, and authorizing the Mayor and City Clerk to
execute the same; and
WHEREAS, on October 10, 2000, by Resolution No. 2170, City Council approved the
Final Map of Subdivision No, 8310 Deer Ridge Village Lots being a Subdivision of the
Remainder, Common Area "E" Mountain View Drive, and Ranchwood Drive, as shown on that
certain Final Map entitled "Subdivision No. 7690 Deer Creek Country Club" (SunCal), located
south of Balfour Road and west of Concord Avenue, accepting the offers of Dedication shown
thereon subject to acceptance of improvements, accepting the improvement security, approving
the Subdivision Improvement Agreement, and authorizing the Mayor and City Clerk to execute
the same; and
WHEREAS, real property generally located west of Concord Avenue and south of
Balfour Road in the City of Brentwood, is needed for flood control purposes, constructing a
portion of Spyglass Drive and for the wetlands in Subdivision No. 8310; and

WHEREAS, Grant of Easements, a Quitclaim Deed and a Grant Deed between the City
of Brentwood and Contra Costa County Flood Control have been developed and are necessary
to transfer properties respectively.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Brentwood
that a Resolution approving the following actions: (1) accepting Grant of Easements from
Contra Costa County Flood Control District for storm drainage easements and Spy Glass Drive
in Subdivision No. 8310, (2) accepting a Quitclaim deed from Contra Costa County Flood
Control District for a previous flowage easement in Subdivision No. 8310, (3) accepting a Grant
Deed for a wetland area in Subdivision No. 8310, generally located west of Concord Avenue
and south of Balfour Road, hereby accepting all or the above real property on behalf of the City,
and authorizing the Mayor or City Manager and City Clerk or any of their designees to execute
the Grant of Easements, and such other documents as may be needed to complete the
transaction; (4) authorizing the Mayor or City Manager and City Clerk or any of their designees
to execute Grant of Easements to Contra Costa County Flood Control in Subdivision; No. 8310,
hereby conveying a portion of real property for replacement of flowage easements and to
provide County access for maintenance of their facilities and such other documents as may be
needed to complete the transaction.
BE IT FURTHER RESOLVED, that the City of Brentwood hereby accepts the real
property described in the Grant of Easements, Quitclaim Deed and Grant Geed.

a regular meeting held on the 14th day of December 2004 by the following vote:
