AFFIRM the County Abatement Officer's determination in the Notice and Order to Abate by finding that the abandoned and open house with dilapidation or improper maintenance, structural hazard, deteriorating floor or floor supports, deteriorating members of walls, buckling due to defective materials, hazardous wiring, faulty weather protection exterior walls, roof, foundation or floors, broken windows or doors, inadequate exit dilapidated stairs, construction of addition without permits on the above-referenced real property is a public nuisance in violation of Contra Costa County Ordinance Code section 2002-46, 712-2.004 . ORDER the property owner(s) to abate the public nuisance by removing occupancy of substandard dwelling and board up the house; or remove occupancy and obtain proper permits to rehabilitate dwelling; or obtain a demolition permit to demolish dwelling and remove debris from property. One of the above listed orders to be completed within 30 days of the mailing of the Board's decision. DIRECT the County Abatement Officer to proceed with the abatement by demolition of the substandard dwelling and removal of all debris; fence off property per County ordinance and charge the cost of work and all administrative costs to the property owner(s) , if the property owner(s) does not comply with the Board' s order to abate the public nuisance. DIRECT the County Abatement Officer to send the Board's decision by first class mail to the property owner(s) and to each party appearing at this hearing, and to file the Board' s decision with the Clerk of the Board of Supervisor. ORDINANCE CODE 14-6.410 NOTICE IS HEREBY GIVEN that the building located at 448 Winslow St.., Crockett, CA, Contra Costa County: APN 354-061-010 is a substandard building. The building has the following violations: 1. Health & Safety Code 1001.1 # 13 general dilapidation or improper maintenance or Adoption of Health & Safety Code Ordinance 17920.3 2. Health & Safety Code # 2 defective or deteriorated flooring or floor supports. 3. Health & Safety Code #3 Structural hazard members of walls or other vertical supports that split, lean are buckle due to defective materials or deterioration. 4. Health & Safety Code Hazardous wiring # D all wiring except that which conformed with all applicable laws in effect at the time of installation if it is currently in good and safe condition and working properly. 5. Costello SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION FISCAL IMPACT: The cost of the demolition of the substandard dwelling, removal of all debris and fencing the property is estimated to be $25,000.00. If the County Abatement Officer performs the work of abatement and the property owner(s) does not pay, the actual cost of the work and all administrative costs may be imposed as a lien on the property after notice and a hearing, and may be collected as an assessment against the property. FACTUAL BACKGROUND: The real property located at 448 Winslow St. Crockett, CA in Contra Costa County; APN: 354-061-010 is owned by James J. Costello. The above-referenced property is located in an R-6 zoning district. California Health and Safety Code 17920.3 states that "Any building or portion thereof including any dwelling unit, guestroom or suite of rooms, or the premises on which the same is located, in which there exists any of the following listed conditions to an extent that endangers the life, limb, health, property, safety, or welfare of the public or the occupants thereof shall be deemed and hereby is declared to be a substandard building. " The premises has the following listed conditions: ❑ General dilapidation or improper maintenance ❑ Defective or deteriorated flooring or floor supports ❑ Members of walls, partitions, or other vertical supports that split, lean list, or buckle due to defective material or deterioration ❑ All wiring, except that which conformed with all applicable laws in effect at the time of installation and which has been maintained in good condition, or which may not have conformed with all applicable laws in effect at the time of installation but is currently in good and safe condition and working properly, and which is free of cross connections and siphonage between fixtures ❑ Deteriorated or ineffective waterproofing of exterior walls, roof, foundations, or floors, including broken windows or doors ❑ Any building or portion thereof which is determined to be an unsafe building due to inadequate maintenance, in accordance with the latest edition of the Uniform Building Code ❑ All buildings or portions thereof not provided with adequate exit facilities as required by this code, except those buildings or portions thereof whose exit facilities conformed with all applicable laws at the time of their construction and which have been adequately maintained and increased in relation to any increase in occupant load, alteration or addition, or to any change in occupancy Per Contra Costa County Ordinance Code 712-4.006, Section 202, Substandard buildings, all buildings or portions thereof, which are determined to be substandard, as defined in this code are hereby declared to be public nuisances and may be abated by repair, rehabilitation, demolition or removal. The County Abatement Officer made an initial inspection of the above-referenced property on June 14, 2004. The County Abatement Officer observed an open abandoned substandard dwelling with debris around the house, broken windows, deteriorated back stairs, hazardous wiring and an addition added to the back of the house. Re-inspection of the property on October 14,2004 showed that the property continued to be in violation of Contra Costa County Ordinance Code Section 2002-46 and 712-2.004. The Notice and Order to Abate was served on the property owner(s) and all known to be in possession of the property by certified mail on October 28, 2004, and posted the above- referenced property on October 28, 2004. The Property owner(s) filed an appeal of the Notice and Order to Abate on November 16, 2004. Costello SPECIFIC REQUEST (S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: OPEN the hearing on the appeal of the Notice and Order to abate a public nuisance on the real property located at 448 Winslow St. , Crockett, CA in Contra Costa County; APN: 354- 061-010; RECEIVE and CONSIDER oral and written testimony and other evidence from the County Abatement Officer, the property owner(s) , and other persons; and CLOSE the hearing. FIND that the facts set forth below are true. AFFIRM the County Abatement Officer's determination in the Notice and Order to Abate by finding that the abandoned and open house with dilapidation or improper maintenance, structural hazard, deteriorating floor or floor supports, deteriorating members of walls, buckling due to defective materials, hazardous wiring, faulty weather protection exterior walls, roof, foundation or floors, broken windows or doors, inadequate exit dilapidated stairs, construction of addition without permits on the above-referenced real property is a public nuisance in violation of Contra Costa County Ordinance Code section 2002-46, 712-2.004 . ORDER the property owner(s) to abate the public nuisance by removing occupancy of substandard dwelling and board up the house; or remove occupancy and obtain proper permits to rehabilitate dwelling; or obtain a demolition permit to demolish dwelling and remove debris from property. One of the above listed orders to be completed within 30 days of the mailing of the Board's decision. DIRECT the County Abatement Officer to proceed with the abatement by demolition of the substandard dwelling and removal of all debris; fence off property per County ordinance and charge the cost of work and all administrative costs to the property owner(s) , if the property owner(s) does not comply with the Board' s order to abate the public nuisance. DIRECT the County Abatement Officer to send the Board's decision by first class mail to the property owner(s) and to each party appearing at this hearing, and to file the Board' s decision with the Clerk of the Board of Supervisor.
