LANGO, DIRECTOR OF GENERAL SERVICES �-��`� _• COSTA DATE: DECEMBER 6, 2005 ��,a� _ COUNTY SUBJECT: SECOND AMENDMENT TO SUBLEASE FOR 1034 OAK GROVE ROAD,CONCORD FOR HEALTH SERVICES DEPARTMENT (T00021) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION 1. APPROVE a Second Amendment to Sublease with Seneca Center, anon-profit corporation, commencing July 1, 2005, for the premises at 1034 Oak Grove Road, Concord under the terms and conditions more particularly set forth in the Second Amendment to Sublease. 2. AUTHORIZE the Director of General Services to EXECUTE the Second Amendment to Sublease. FINANCIAL IMPACT Commencing July 1, 2005 through June 30, 2006, the annual rental from Seneca.shall be $1.00. This rental is a decrease of $336,000 from the previous rental for the same period. Revenues are credited to the Health Services Department since all expenditures for the facility are charged to Health Services. The Second Amendment has a provision of three one-year extensions of the Sublease at an annual rental of$1.00. BACKGROUND Contra Costa Health Services Department has contracted with Seneca Residential Day Treatment for services since June 2001. Due to the high costs involved with operating a secure Community Treatment Facility, the funding for this contract included State Early Periodic Screening, Diagnosis and Treatment Program (EPSDT) and County Realignment. During the 2005/2006 contract negotiations, Health Services and the CAO's office agreed to restructure the contract terms, alleviating Seneca's annual rent obligation of $336,000 payable to the County. In return, the County would be relieved from appropriating Realignment funds, which in 2004/2005 amounted to $427,050. The new terms of the service contract also changed the payment provisions from acost-based contract to afee-for-service contract.
