County STA SUBJECT: Secondhand Smoke Ordinance -------------------------------------------------------------------------------------------------------------------------------------- SPECIFIC REQUEST(S)OR RECOMMENDATIONS(S)&BACKGROUND AND JUSTIFICATION - RECOMMENDATIONS 1. Direct Contra Costa Health Services staff to research and present to the Board of Supervisors a menu of options for a draft model ordinance that would expand secondhand smoke protections to workplaces not covered by LC6404.5, outdoor areas and multi-unit residences. 2. Report to the Family and Human Services Committee to report back the findings from the studies in 90 days. BACKGROUND: Secondhand smoke has been designed a'Class A, known human carcinogen by the U.S. Environmental Protection Agency. The California Environmental Protection Agency released a study in October 2005 containing new, stronger evidence linking secondhand tobacco smoke to a wide variety of adverse health effects, including increased incidences of cancer, heart disease and respiratory ailments, as well as the increased incidences of breast cancer in non-smoking pre- menuopausal women. Contra Costa County and its cities have addressed the dangers of secondhand smoke exposure through two ordinances. In 1984, Contra Costa County Board of Supervisors and all 18 City Councils became the first multi-jurisdictional region in the nation to adopt uniform legislation restricting smoking in the workplace and public spaces. hl 1991, the Board of Supervisors adopted the clean indoor air ordinance banning smoking in workplaces and restaurants with exceptions for bar areas, and restricting smoking in bowling alleys and bingo parlors. The ordinance also restricted vending machines. Between 1991 and 1994, 15 of 18 Contra Costa cities adopt a version of the County's clean indoor air ordinance. While Contra Costa residents enjoy the benefits of some of the strongest smoke-free laws and ordinances in the Country, they still face health risks associated with secondhand smoke exposure. Residents are exposed to secondhand smoke in some workplaces, at public events, in public parks, in outdoor dining areas, in multi-unit housing complexes and on health care campuses, to name a few. Since 2000, Contra Costa Health Services Tobacco Prevention Project has received increasing numbers of complaints about smoking in these areas. The County spends $228 million annually to treat smoking related illnesses. These costs could be decreased if fewer residents were exposed to secondhand smoke, and if more residents stopped smoking. Research shows that prohibiting smoking in workplaces and public areas supports the quit efforts of smokers. State law allows local jurisdictions to expand upon the protections provided by state law, and to restrict smoking in many areas that are not covered by state or federal law. Contra Costa County has taken the lead in this area and should now look for new ways to expand smoke-free living and working.
