ADOPT Resolution No. 2005/ for SD 00-08149, accepting completion of landscape improvements for
Subdivision Agreement (Right of Way Landscaping) for project being developed by Windemere BLC Land
Company, LLC, San Ramon(Dougherty Valley) area. (District III)
FISCAL IMPACT:
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS :
The developer, Windemere BLC Land Company, LLC, has completed the landscape improvements per the
Subdivision Agreement(Right of Way Landscaping), and in accordance with the Title 9 of the County Ordinance
Code.
CONSEQUENCES OF NEGATIVE ACTION:
The completion of improvements Will not be accepted and the maintenance/warranty period will not begin.

These improvements are located along Adelaide Hills Court, Andreas Court, Allann-lere
Court, Angsley Court, Angsley Lane, Andreas Way, Allanmere Drive, and Arrowfield Way.
The Public Works Director has notified this Board that the Right of Way Landscaping
improvements for SD 00-08149, .have been completed as provided in the Subdivision Agreement
(Right of Way Landscaping)with Windemere BLC Land Company, LLC, heretofore approved by
this Board;

NOW THEREFORE BE IT RESOLVED that the landscape improvements have been
COMPLETED as of December 20,2005 thereby establishing the six-month terminal period for the
filing of liens in case of action under said Subdivision Agreement(Right of Way Landscaping):

BE IT FURTHER RESOLVED the payment (labor and materials) surety for $65,000.00,
Bond No. 11127507793 issued by the above surety be RETAINED for the six month lien guarantee
period until June 20, 2006, at which time the Clerk of the Board is AUTHORIZED to release the
surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that the Right-of-Way Landscaping improvements on
Adelaide Hills Court, Andreas Court, Allaninere Court, Angsley Lane, Andreas Way, Allanmere
Drive,and Arrowfield Way are ACCEPTED AS COMPLETE.Upon completion of the warranty
and maintenance period,the San Ramon City Council shall accept the landscape improvements for
maintenance in accordance with the Dougherty Valley Memorandum of Understanding.
BE IT FURTHER RESOLVED that the beginning of the warranty and maintenance period is
hereby established, and the $1,300.00 cash deposit (Auditor's Deposit Permit No. 382409, dated
March 1,2002)made by Windemere BLC Land Company.,LLC,and the performance/maintenance
surety bond rider for $19,310.00, Bond No. 11127507793 issued by The American Insurance
Company be RETAINED pursuant to the requirements of Section 94-4-406 of the Ordinance Code
until release by this Board.
All deposit permits are on file with the Public Works Department.

Rider to be attached to and form a part of Bond Number I 112750 7793 ., dated the 27th day
of February.,2002 executed by The American Insurance Company , Surety,on behalf of Windemere
BLC Land Com an LLC , Principal, and in favor of the County.of Contra Costa , Obligee.
It is understood and agreed that the Bond Penalty is changed:
From: One Hundred Twenty Eight Thousand Seven Hundred and no/100 dollars
($128,700.00)
To: Nineteen Thousand Three Hundred Ten and no/100 dollars ($19,310.00)
Effective: September 6, 2005
Provided, however, that the aggregate liability of the Principal and Surety shall not exceed the amount of
liability assumed at the time the act and/or acts of default were committed and in no event shall such liability
exceed the larger of the above mentioned sums. The liability of the Principal and the Surety under the Bond
and under the Bond as changed by this rider shall not be cumulative.
Nothing herein contained shall be held to vary, waive, alter, ,or extend any of the terms, conditions,
aareements or warranties of the above mentioned Bond other than as stated above.
