SUBJECT: APPROVE FOURTH EXTENSION OF TIME TO COMPLETE CONSERVATION
EASEMENT ON THE NORTH GATE ROAD PROPERTY (DISTRICT III)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE a three-month extension of time to the East Bay Regional Park District to March 21, 2006 to
complete the conservation easement document and funding on the 36-acre parcel owned by the Flood Control
District adjacent to the Milton F. Kubicek(Pine Creek) Detention Basin located on North Gate Road in the
Walnut Creek area. (District III)

II. Fiscal Impact:
The Flood Control& Water Conservation District(District)will receive $1.559 million for a conservation
easement on a parcel the District owns on North Gate Road. Pursuant to an agreement with the State
Department of Water Resources, all revenue generated from the conservation easement must go towards
Flood Control infrastructure improvements in the Walnut Creek watershed. There is no interest provision
for delays in securing the funding.
III. Reasons for Recommendations and Background:
On November 3, 2005 the Finance Committee (Committee) considered a status report on the conservation
easement. Attached is the staff report to the Committee,dated October 19,2005,outlining the issues considered
by the Committee.
The easement document has been finalized between the Costal Conservancy, the Park District and the Flood
Control District.The document is currently under review by the State Department of Conservation in relation to a
proposed agricultural contract cancellation on the Humphrey's property.
A large part of the funding package for the easement is from an agricultural contract termination exchange on the
Humphrey's property in the Alamo area.The Board of Supervisors recently approved the proposed project on the
Humphrey's property and the cancellation of the agricultural contract. The cancellation of the agricultural
contract process is nearing completion. Other funding for the easement is from the Park District and the City of
Walnut Creek. Approval of funding from the Park District is anticipated to be on their Board agenda in
December and the same schedule is anticipated for funding approval from the City of Walnut Creek.
On July 12, 2005,the Board approved the third extension of time to complete the conservation easement until
December 21, 2005. It appears that the Department of Conservation will not complete their review before
December 21, 2005 and the Finance Committee is recommending an extension for three months to March 21,
2006 to allow the Department of Conservation to complete their review.
IV. Consequences of Negative Action:
The conservation easement deadline would not be extended.
