SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
ADOPT Ordinance No. 2004-40 to rezone approximately 4.38 acres from General
Agricultural, A-2, to Single Family Residential, R-40, as introduced by the Board on October
20, 2004.
FISCAL IMPACT
None. The applicant is responsible for the cost of processing the rezoning request.
BACKGROUND
On October 20, 2004 the Board conducted a hearing on the County Planning Commission
recommendation to rezone 4.38 acres located at#999 North Gate Road in the Walnut
Creek/North Gate area from General Agricultural (A-2) to Single Family Residential, R-40. After
completing the public hearing, the Board voted to adopt the proposed rezoning; introduced the
ordinance giving effect to the rezoning; waived the reading; and directed staff to return with the
second reading for the adoption of the proposed rezoning.

The Contra Costa County Board of Supervisors ordains as follows:
SECTION I: Page N-16 of the County's 1978 Zoning Map(Ord.No.78-93)is amended by re-zoning
the land in the above area shown shaded on the map(s) attached hereto and incorporated herein
(see also Community Development Department File No. RZ033136
FROM: Land Use District A-2 General Agriculture
TO: Land Use District R-40 Single Family Residential
and the Community Development Director shall change the Zoning Map accordingly, pursuant to
Ordinance Code Sec. 84.2.003. M

SECTION 11. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within
