SUBJECT: APPROVE and RATIFY the decision of Kleinfelder,Inc.,as General Manager of Blackhawk
Geologic Hazard Abatement District(GRAD)to award a landslide repair contract to Engineered Soil
Repairs(ESR),Walnut Creek, California in the amount of$113,127,for the repair of landslide damage
on the slope of the Blackhawk Plaza Parking Lot within the property of the Blackhawk Plaza,and
AUTHORIZE Kleinfelder,Inc., as General Manager of the Blackhawk Geologic Hazard Abatement
District(GRAD)to execute contract change orders as may be required up to 10%of the contract amount,
Danville area. (District III)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
APPROVE and RATIFY the decision of Kleinfelder,Inc.,as General Manager of Blackhawk Geologic Hazard Abatement
District(GHAD) to award a landslide repair contract to Engineered Soil Repairs (ESR), Walnut Creek, California in the
amount of$113,127, for the repair of landslide damage on the slope of the Blackhawk Plaza Parking Lot for the period
September 1 6, 2004 through November 30, 2004 within the property of the Blackhawk Plaza, Danville area; and
AUTHORIZE Kleinfelder, Inc., as General Manager of the Blackhawk Geologic Hazard Abatement District(GHAD)to
execute contract change orders as may be required up to 10%of the contract amount.

FISCAL IMPACT:
No impact on the County General Fund. The funding is one hundred percent (100%) Blackhawk CHAD. The proposed
contract is consistent with the adopted FY 04/05 program budget.
REASONS FOR RECOMMENDATIONS AND BACKGROUND:
In April of 1998 the Keystone retaining wall supporting the slope below the Blackhawk Plaza parking lot failed.The failure
was about 5 5 feet wide and extended about ten feet beyond the top of the slope displacing the concrete curb and several feet of
the asphaltic concrete pavement.The failure occurred after weeks of unusually heavy rainfall.Kleinfelder was authorized to
prepare a slide repair investigation, which was completed in October 1998. Because of the simultaneous occurrence of
numerous other slides in the District the repair of the Plaza slide was postponed.
The slope repair was included in the FY 2003/2004; however, due to project scope discussions with the Plaza Board of
Directors the project was again delayed to FY 2004/2005.The slide area has grown each year and currently presents a safety
hazard for cars parking at the top of the slope. Although,barricades and concrete wheel stops have been installed around the
site vandals continue to remove the car wheel stops.
CONSEQUENCES OF NEGATIVE ACTION:
Without Board approval the CHAD will not be able to authorize the contract that has been let for the repair. The ongoing
safety issue with regard to cars driving over the top of the failure area will worsen exposing the CHAD and the Plaza to
liability.
