SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
APPROVE and AUTHORIZE the Redevelopment Director, or designee, to execute a Fourth
Amendment to contract with Allan D. Kotin & Associates, effective November 1, 2004, to
increase the payment limit by $30,000 to a new payment limit of $178,500 to provide
continued financial consulting services at the Pleasant Hili BART Station, with a new term
extending through December 31, 2005.
FISCAL IMPACT:
No General Fund impact. Budgeted Agency tax increment funds will be used.
BACKGROUND:
The County, the Redevelopment Agency, and BART have formed a Joint Powers Authority at
Pleasant Hill BART to ground lease the BART property for a mixed-use development
comprised largely of residential rental, office, and neighborhood serving retail. The
development program would also include a for-sale residential piece on land to be sold in fee
title. A limited partnership formed by Milleunnium Partners is the development entity.
The JPA staff from the Agency and BART have been engaged in business negotiations with
Millennium for some time, and are close to concluding on a business term sheet. This term
sheet will be the basis for developing the legal documentation, including Disposition &
Development Agreements and Ground Leases. The financial consulting services of Allan Kotin
& Associates are essential for a successful conclusion.

RESOLUTION OF CONTRA COSTA COUNTY HUMAN RELATIONS COMMISSION
SUPPORTING ASSEMBLY BILL 1967,
THE MARRIAGE LICENSE NON-DISCRIMINATION ACT
WHETS,Contra Costa has by local policy and ordinance shown its commitment to fair and
equitable treatment of all persons regardless of gender or sexual orientation, and
WHEREAS,Contra Costa is home to thousands of families headed by same-sex couples, many

WHETS,these families deserve the sante rights and legal protections as other families under the

WHEREAS,civil marriage bestows thousands of state and federal rights, protections, and
responsibilities that are otherwise unavailable to gay and lesbian families, and
WHEREAS,discriminatory marriage laws result in significant harm to lesbian, gay, bisexual, and

ostracism,and
WHEREAS,both the United States Constitution and California Constitution clearly state that no
person will be denied equal protection of the laws, and
WHEREAS,discriminatory marriage laws undermine the state of California's commitment to
equality, privacy, and justice for all of its citizens, and

WHEREAS,the opportunity to publicly and legally commit to share one's life with a person of
one's choice is for many people one of the most central aspects of human experience, and denial of

The Commissioners urge the California State Legislature and Governor Arnold Schwarzenegger
