RECOMMENDATIONS
AUTHORIZE the Chair to sign letters to freight railroads and their industrial customers in
Contra Costa County, asking them to meet with the Transportation, Water and
Infrastructure Committee to discuss relocation of spurs for rail cars that contain hazardous
material, to areas inside the secured areas of industrial facilities.

BACKGROUND/REASONS FOR RECOMMENDATIONS
The County's adapted legislative goals for transportation in 2004 include the goal of
improved security for railroad and maritime port facilities. The Board of Supervisors has
referred this matter, along with other transportation goals,to the Transportation,Water and
Infrastructure Committee for review and recommendations. The Committee has met twice
this year with railroad officials to discuss concerns over the proximity of freight railroad cars
to residential neighborhoods, including rail cars that contain hazardous materials on their
way to and from industrial plants. At the Committee meetings of July 12 and again on
October 11, the Committee asked railroad officials whether the railroad cars could be
stored in secure locations such as within the plants of the railroads' industrial customers,
rather than being stored on railroad spurs or sidings which are more exposed to public
access and therefore more vulnerable to security breaches.

BACKGROUND/REASONS FOR RECOMMENDATIONS (Continued)
Officials of Union Pacific Railroad told the Committee on October 11 that most of the
locations where rail cars sit for extended periods of time are on "spurs,"which are short rail
lines that lead from the main tracks into a specific industrial plant. These spurs are owned
or leased by the industries themselves and it would be the industries' decision as to
whether to store the rail cars somewhere else, such as inside their own plants.
Occasionally freight trains also are seen sitting on"sidings,"which are side tracks owned and
operated by the railroads. Sidings are used when two trains both need to use the same set
of tracks. One of the trains moves onto the siding to allow the other train to pass by on the
main track. Then the train on the siding moves back on to the main line and proceeds to its
destination. Railroad officials said the sidings are used as a traffic-control device and trains
don't sit on them for long, typically just long enough to enable the other train to pass by.
Conflicting testimony on the issue of"spur storage" has been received.
Since most of the rail cars that are stored for longer periods of time are sitting on privately
owned spurs, any decision to stop storing them on spurs and move them into the
industries' own plants would have to involve representatives of those industries.
The Transportation,Water and Infrastructure Committee recommends the Board authorize
the Chair to contact the railroads and their freight customers in Contra Costa County, to
discuss the possibility of moving the storage of rail tank cars to sites within the industrial
customers' plants, or to some other secure location and remove them from the vicinity of
residential neighborhoods and other publicly accessible locations.
Prior discussions of this issue in past years have revealed the County has little or no
jurisdiction over any aspect of railroad operations. County Counsel in August 2001 advised
that most railroad matters are subject to federal regulation, and the County has no authority
to impose requirements on railroads. In matters not preempted by federal law,the state has
preempted County police power regulation of railroads. State regulations give the County
some responsibility for monitoring the storage of rail cars with hazardous materials. Under
these requirements,the County Health Services Department's Hazardous Materials Division
works with local industries to develop emergency response plans in the event of a leak of
hazardous materials from stored tank cars. The County has the right—via Public Utilities
Commission General Order 161 --to ask the freight railroads to provide information about
the location of hazardous materials stored in rail cars on tracks leased by the railroads in
Contra Costa County, meaning spur tracks. The railroads are required to respond in writing
within 60 days. This right extends only to railcars that are "stored", meaning rail cars that sit
in the same location for more than 30 days. Cars sitting for less than 30 days are considered
to be in transit and are not subject to the same reporting requirements.
County Counsel also advised that the County's Industrial Safety Ordinance applies to
stationary sources. An industrial plant using hazardous materials is considered a
stationary source. Railroads are not considered a stationary source.
The Transportation, Water and Infrastructure Committee recommends that railcars no
longer be stored on any railroad tracks that are accessible to the public, moving them
instead to more secure locations. Railroad officials at the October 11 Committee meeting
indicated a willingness to meet with their customers and the Transportation, Water and
Infrastructure Committee to see if there are any feasible ways to accomplish this goal.
Exhibit A is a draft letter for the Chair's signature, requesting the affected parties meet with
the Transportation, Water and Infrastructure Committee to discuss the issue.
County staff is in the process of identifying the railroads' customers who have spurs in
Contra Costa County. All such customers will receive the letter, along with the two freight
railroads who operate the main-line tracks (Union Pacific and Burlington Northern Santa
Fe), and the Richmond Pacific Railroad, which operates about two miles of tracks that
connect the main line tracks to the Richmond Terminal.

On this day the Board considered authorizing the Chair, Board of Supervisors to consider
signing letters to freight railroads and their industrial customers, asking them to meet
with the Transportation, hater and Infrastructure Committee on issues relating to rail
tank cars and their proximity to residential areas and local streets and highways, as
recommended by the Transportation,Water and Infrastructure Committee,
The Board invited comments from the public, and no one appeared to speak.
The Board requested the Chair to sign a letter to Union Pacific Railroad and Burlington
Northern Santa Fe Railway as well as their industrial customers that owned or leased
spurs to participate in a meeting in Martinez to discuss issues related to rail tank cars to
residential neighborhoods and local streets and highways.
Supervisor Uilkema suggested noticing this meeting as a full Board meeting, and
Supervisor Gioia suggested adding Richmond Pacific Railroad to attend the meeting.
After further discussion the Board took the following action:
• AUTHORIZED the Chair to sign letters to freight railroads and their industrial
customers in Contra Costa County, asking them to meet with the Transportation
Water and Infrastructure Committee to discuss relocation of spurs for rail cars that

the letter and include Pacific Railroad to participate in discussions;

and highways. This issue grew out of our concerns that freight cars containing hazardous materials are
sometimes stored on spurs and sidings that are relatively accessible to the public and therefore are
vulnerable to sabotage, creating a potential public health problem.
