I lease this property from the Union Pacific Railroad. Originally I had a five year lease beginning June 17, 1997 which was converted to a twenty year lease December 15,2000. In all this time there were no complaints from neighbors or county officials, in fact neighbors said they were happy to have the horses on the property because prior to my leasing the property the homeless lived on it and people used the land as a dump site. In September/October 2003 the land in front of this property began being developed and I began receiving communications from the county saying horses are not allowed on land zoned Heavy Industrial. For the past year I have hied to find a compromise that would allow me to keep the horses on this property and satisfy the county. The "old "neighbors do not object to the horses (see attached A) and apparently the "new" neighbors don't object to horses either (see attached B). With this in mind I am again asking that an exception be made and that I be allowed to stable the horses on this property until my lease is finished. However- If you should decide not to allow the horses to stay on the property then I am respectfully requesting the following: 1. That I be given until the end of this calendar year (December 31, 2004) to move the horses. I have made tentative arrangements to relocate the horses if need be however I need to reinforce a pre-existing roadway, fence the area, build stalls, before the horses can move there. 2. 1 will need to dismantle the current stalls, salvage what materials I can,transport items to the new location, purchase gravel and other needed materials, and pay more rent at the new location,so I am requesting financial assistance in the sum of$20,000.00 to accomplish this. 3. All fees, penalties, fines related to this situation be waived. 4. Since I still have thirteen years left on my lease with Union Pacific Railroad I would life the county to see that the developer, O'Brian Group, buildsa fence separating his property from mine. 5. Last, if you should decide not to allow me to continue stabling horses on the property I would like a list of activities allowable on property zoned Heavy Industrial. Sincerely, James H. I am appealing the order of abatement because I have: 1. cleared any substantial amounts of trash,debris,rubbish, and garbage,trailers(with the exception of licensed horse trailers),vehicle parts,vehicles,broken or neglected equipment,machinery,refrigerators,freezers,shopping carts,discarded household equipment,broken and discarded furniture from the approximately three acres which I lease from Union Pacific Railroad, 2. It is my understanding that others who lease railroad property for horses have not been issued a Notice and Order to Abate and 1 respectfully request an explanation,in writing,as to why the ordinance -C.C.C.Ordinance Code 14-6.410 is not being unforced uniformally. 3. I am in the process of making arrangements for horses and stables to be relocated. As you must know it is extremely difficult to find an affordable,safe location within reasonable commuting distance on which to stable horses.4. Since all the horse owners with me are employed,once the new arrangements are finalized,we have only weekends to dismantle the stalls and fencing and re construct them. In closing I would like to add that any additional debris that is currently on the property belongs to the builder, O"Brian Group,who is building the development directly in front of mine and is using the property without my permission,and/or the homeless.
