RECOMMENDATION(S):
ADOPT Resolution No. 2004/ 564 for Road Acceptance 01-41121 (cross-reference Subdivision 01-08570),
accepting Offer of Dedication for Slope Easement, being developed by Hofmann Land Development Company,
Byron area. (District III)
FISCAL. IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATIONS):
Hofirlann Land Development Company was conditioned to widen Bider Road for Subdivision 01-08570. As a
result of the widening along the East Contra Costa Irrigation District Canal,a slope easement is required for future
maintenance of the road and slope.
CONSEQUENCES OF NEGATIVE ACTION:
The slope easement will not be accepted and rights to maintain the road and slope will not be obtained.

OFFER OF DEDICATION - SLOPE EASEMENT
EAST CONTRA COS'T'A IRRIGATION DISTRICT, the undersigned, beim the present title
owner of record of the herein described parcel of land, hereby makes an irrevocable offer of
dedication to CONTRA COSTA COUNTY and its successors or assigns, of a slope easement for
access and maintenance of work and the clearing of obstructions and vegetation, upon the real
property situated in the County of Contra Costa, State of California, described in Exhibit "A" (written
description) and shown on Exhibit "B" (plat map) attached hereto.
It is understood and agreed that CONTRA COSTA COUNTY and its successors or assigns shall
incur no liability with respect to such offer of dedication, and shall not assume any responsibility for
the offered parcel of land or any improvements thereon or therein,until such offer has been accepted
by appropriate action of the Board of Supervisors, or of the local governing body of its successors
or assigns.
It is understood and agreed that CONTRA COSTA COUNTY shall save and hold EAST
CONTRA COSTA. IRRIGATION DISTRICT free and harmless from and to indemnify EAST
CONTRA COSTA IRRIGATION DISTRICT against any and all claims of personal injury or
property damage as a result of County or County's contractors exercise of the rights granted herein.
The provisions hereof shall inure to the benefit of and be binding upon the heirs, successors, assigns,
and personal representatives of the respective parties hereto.
