SUPERVISORS AND COUNTY ADMINISTRATOR ALUC(via CDD) County Counsel DEPUTY CAO BY •/ '`. =` F r , October 12,2004 Board of Supervisors County Initiated General Plan Amendment and Rezoning to bring conformance with Airport Land Use Compatibility flan Wage 2 FISCAL IMPACT None. BACKGROUND f REASONS FOR RECOMMENDATION On December 16, 2003 the Board of Supervisors opened the public hearing on the three related actions related to the ALUC Airport Land Use Compatibility Plan: • Airport Land Use Compatibility Plan General Plan Amendment (County File: GP#02-0001). • County initiated Rezoning for conformance with the ALUC Airport Land Use Compatibility Plan. • County initiated repeal of the Airport Zoning Ordinance, Chapter 86-4,County Ordinance Code (County File: ZT#02-0004) This matterwas continued to a fixed hearing date at 1:00 p.m., March 23,2004 and the Board granted a further continuance of the public hearing to 1:00 p.m., April 27, 2004 in order to review matters pertaining to the proposed rezoning of property near the Byron Airport, as recommended in the Airport Land Use Compatibility Plan, with the ALUC. It was continued again to June 15, 2004 at the request of the ALUC in order to review new information from the updated California Airport Land Use Planning Handbook, as submitted to them from the County, which relates to the appropriate zoning and densities for certain properties adjacent to the Byron Airport. When the Board last dealt with scheduling this matter it was expected that the ALUC would have completed its review over the summer and a hearing could be scheduled for September 28, 2004. The ALUC has approved in concept a revision and update to the Airport Land Use Compatibility Plan for a compatibility zone around the Byron Airport, as requested by Contra Costa County. The ALUC's most recent action means that the Board will not need to overrule the ALUC in order to approve the County Planning Commission recommendation to retain the A-2: General Agricultural District for certain properties adjacent to the Byron Airport. However, the ALUC must conduct a public hearing and formally adopt this change to the Airport Land Use Compatibility Plan. The ALUC has not yet set a public hearing date. Therefore, it will be necessary to continue the Board's public hearing on the three actions to bring the County conformity with Airport Land Use Compatibility Plan. Staff is recommending that the public hearing be continued to a future date to be determined following the ALUC's own public hearing and subsequent adoption of the changest to Airport Land Use Compatibility Plan. Staff is also recommending that the Board's future hearing be re-noticed for this matter. GAAdvancd PlannN\advplanZoard 6rdam\bomntkx aiucpWi 412.64.dac
