SUBJECT: Accepting completion of warranty period and release of cash deposit for faithful performance,
Minor Subdivision 99-00404.
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION(S):
ADOPT Resolution No. 2004! 548 for Minor Subdivision 99-00004, accepting completion of warranty period
and release of cash deposit for faithful performance, being developed by DeNova Homes, Walnut Creek area.

FISCAL IMPACT:
None.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The improvements have met the guaranteed performance standards for the warranty period following completion
and acceptance.
CONSEQUENCES OF NEGATIVE ACTION:
The developer will not receive their deposit or have their performance surety exonerated as guaranteed by the
Subdivision agreement.

RESOLUTION NO. 2004/ 548
SUBJECT: Accepting completion of warranty period and release of cash deposit for faithful
performance, Minor Subdivision 99-04004, Walnut Creek area. (District III)
On April 15, 2443, this Board resolved that the improvements in Minor Subdivision 99-
00004 were completed as provided in the Subdivision Agreement with DeNova homes, Inc., and
now on the recommendation of the Public Works Director;
The Board hereby FINDS that the improvements have satisfactorily met the guaranteed
performance standards for the period following completion and acceptance.NOW THEREFORE BE
IT RESOLVED that the Public Works Director is AUTHORIZED to refund the $1,000.00 cash
deposit(Auditor's Deposit Permit No. 358935, dated November 8, 2000)plus interest to DeNova
Homes,Inc.in accordance with Government Code Section 53079(if appropriate),Ordinance Code
Section 94-4.406, and the subdivision agreement.
BE IT FURTHER RESOLVED that the warranty period has been completed and the
Subdivision Agreement and performance surety bond.for 12,904.00,Bond No. 5503013,issued by
Financial Pacific Insurance Company are exonerated.
