amendmentlextension with Nielsen, Merksamer, Parrinello, 'Mueller and Naylor to increase the payment amount
from $20,000 to $70,000 to provide advise and legal representation on Indian Gaining issues for the period
August 1, 2004 to March 1, 2005,

BACKGROUND/REASON(S) FOR RECQMMENDATION(S):
The law firm of Nielsen, (Merksamer, Parrinello, Mueller and Naylor ("Nielsen Merksamer") has extensive
experience with Indian Gaming issues and has represented multiple counties in their dealings with Indian gaming
proposals. They are principal consultants to the Governor on his"no" on Propositions 68 and 70 campaign.
Cathy Christian, who would be the primary consultant under this contract, has represented Yolo, Sonoma, Marin
and Tulare counties on Indian gaming issues. She is a nationally recognized expert on Indian Gaming issues.
Prior to joining the firm of Nielsen Merksamer, Cathy served in the California Attorney General's office, where
she was a senior advisor to the Attorney General on gambling and Indian law and was General Counsel to the
California Horse Racing Beard. Cathy is also Contra Costa County's lead legislative advocate in Sacramento,
and so has an excellent understanding of County Issues

BACKGROUND/REASON(S)FOR RECOMMENDATION(S):
When the issue of Indian Gaming first emerged, the County Administrator entered into a $20,000 contract with
Nielsen, Merksamer to provide advise and legal representation on Indian Gaming issues. With the expansion in
the number of proposals and the complexities and controversies that have emerged, it is clear that a more
extensive contract is now appropriate.

SUBJECT: Retirement System Consultant
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommendation:
Approve and authorize the County Administrator to execute a contract amendment with Public
Pension Professionals, Inc. to extend the termination date from October 13, 2004 to October 13,
2005, to provide expert assistance on retirement system matters.
Background:
On August 13, 20702 the Board of Supervisors approved a request for qualifications to be sent out
for a pension system expert. The intent of contracting for an expert was for the County of obtain
independent expertise in formulating short-term and long-term strategies to mitigate County
pension system costs. In September, County staff selected Public Pension Professionals, Inc.
Over the last 24 months the consultant has assisted the County Board of Supervisors and County
staff on several critical issues. These issues include the issuance of pension obligation bonds,
costing of retiree health benefits and analysis of the excess earnings policy of the Retirement
Board.
Over the next 24 months, it is expected that retirement costs will need to be forecasted over
multiple years and existing retirement legislation and future proposals will require technical
analysis.
There is no change to the payment limit.

It is the goal of the Healthy Aging Initiative to identify, encourage, and support collaborative efforts directed at
preparing communities for the rapidly growing aging population. According to the 2000 census, the Contra
Costa County population is 37%"boomers",those born 1946 through 1964 and they are expected to live well
into their 80's and 90's. The community engagement strategic plan process of the John Muir/Mt. Diablo
Community Fund for the Healthy Aging Initiative is designed to mobilize cross sections of the community to
address issues of aging.
The Healthy Aging Initiative will target four domains of an Elder-Friendly Community: Basic needs, such as,
affordable housing, neighborhood safety,hunger and information availability; Promotion of Social and Civic
Engagement making aging issues a community-wide priority; Optimize Phymi .,al H lth,Mental Health and
Well,; and, �VlaximizInd =deuce for h Fraii and Disahled. To effectively identify and implement
solutions for addressing these areas, the Healthy Aging Initiative will develop a strategic plan for aging and
adult services in Contra Costa County. The process will include a countywide needs assessment and a
community survey of the aged and their families with focus groups conducted in all geographic areas of the
County. Upon development of a plan for program strategies, the plan can be marketed regionally to adopt aging
friendly policies.
County funding will help support surveys for information, convening and planning processes,public
information and marketing-campaigns including a website, and plan evaluation. Foundations in the area are
contributing over one and one half million dollars to this multi-year initiative.

CHILDREN'S IMPACT STATEMENT-
The Project will support three of the five community outcomes established in the Children's Report Card,
2) "Children and Youth Healthy and Preparing for Productive Adulthood", 3)"Families that are Economically
Self Sufficient", 5)"Communities that are Safe and Provide a High Quality of Life for Children and Families"
by providing interactive youth focused training to child social workers to understand the needs of foster youth
and families as they move toward self-sufficiency.
RACKGROTIND.
The Y.O.U.T.H. Training Project will address the problem of foster youth who are beginning to transition out of
foster care by training 400 child welfare workers using an innovative, interactive youth focused curriculum and
recruiting and developing teams of current and foster youth ages 16—22 years to deliver youth lead trainings.
Using a youth development perspective and team building techniques, these youth will develop the skills and be
empowered to deliver a training focused on changing social worker knowledge, skills and values concerning
communication with foster youth.
The Project will provide child welfare staff development and training services to improve the quality and
outcome of services to children and families in the child welfare system.
The Employment and Human Services Department, as an active leader in the Bay Area Social Services
Consortium,will act as the lead agency for the project,receiving and distributing funding and will provide
leadership to Child Welfare Redesign Cohort One counties in developing this project and ensuring that training
is provided to staff from all Cohort One counties.

RECOMMENDED ACTION:
Approve and authorize the Health Services Director to execute on
behalf of the County, Contract #23-157-13 with Robert DeCesare, a
self-employed individual, for the period from October 1, 2004
through September 30, 2005, in an amount not to exceed $1.27, 300,
for consultation and technical assistance to the Department ' s
Divisional Directors regarding compliance with billing and privacy
issues .
FISCAL:
Funding for this Contract is included in the Health Services
Department ' s Enterprise I Budget.
BACKGROUND/REASON(S) FOR RECOMMENDATIONS) :
On September 9, 2003, the Board of Supervisors approved Contract
#23-1.67-12 with Robert DeCesare to provide consultation and
technical assistance to the Health Services Division Directors
with regard to compliance with Medicare and Medi--Cal rules and
regulations covering reimbursement for patient services .
Approval of Contract #23-157-13 will allow the Contractor to act
as the County Privacy Officer and the Compliance Officer, this
includes consultation and technical assistance to the Department
regarding compliance with billing guidelines related to fraud and
abuse, and to ensure compliance with HIPAA privacy regulations,
through September 30, 2005 .
