RECOMM MATION(S) :
Approve and authorize the Health Services Director, or his designee (Lew
Pascalli, Jr. ) , to execute on behalf of the County, Contract #22-855,-3 ,
with Robert A. Katin (dba Katin Engineering Consulting, a self-employed
individual, in an amount not to exceed $34, 700, to provide Industrial
Safety Ordinance (ISO) mandated communication and education services to
communities neighboring industrial plants in West County, for the period
from January 15, 2004 through June 15, 2004 .
FISCAL IMPACT:
This Contract is funded 100% by Industry fees .
BACKGROUTND/REASON(S) FOR RECOMMENDATION(S) :
On January 15, 1999, the Contra. Costa Board of Supervisors adopted an
Industrial Safety Ordinance (ISO) #94-48 to supplement requirements', of
the Federal Risk Management Program and the California Accidental
Release Prevention Program. The ISO currently applies to seven (7)
specified industrial facilities in unincorporated areas of Contra Costa
County. The ISO requires the development of safety plans,
implementation of safety programs, investigations and root-cause
analysis to allow the public the opportunity to provide input into the
development of the safety plans and safety programs .)
Under Contract #22--855-3, Contractor shall act, on behalf of the County,
as the ISO Public Participation Facilitator to provide communication and
education services to the community in West County and implement', an
intensive public participation program for the Hazardous Materials
Program, through June 15, 2004 .

execute on behalf of the County, Contract Amendment Agreement#22-879-2 with Halberto
O'Connor, a self-employed individual, effective January 1, 2004, to amend Contract#22-879-
1, to increase the total Contract Payment Limit by $13,736 from $25,000, to a new total
payment limit of$38,736.
FISCAL IMM:
This Contract is funded by 100% Federal Healthcare for the Homeless Grant.
On November 2003, the County Administrator approved and the Purchasing Services Manager
executived Contract#22-879-1 with Halberto O'Connor, for the period from November 1, 2003
through October 31, 2004, for the provision of support services for the Health Care to the
Homeless Mobile Medical Team.
Approval of Contract Amendment Agreement#22-879-2 will allow the Contractor to provide
additional hours of services, through October 31, 2004.

RECOMMENDATION
1. APPROVE a Consulting Services Agreement with bate Keating Associates, Inc. ("Consultant")

2. AUTHORIZE the Director of General Services, or designee, to execute the agreement and to
issue written Authorizations for extra work provided that the cumulative total extra cost for all
such authorizations shallnot exceed $5,000.
FINANCIAL. IMPACT
The Services contract will be funded by the Minor Buildings Improvement budget.
BACKGROUND
The goal of the Countywide signage program is to establish standardized signage designs and details
that would eventually apply to County buildings. The signage standards would also be incorporated
into the plans and specifications of any new facilities projects. The County currently has a myriad of
signage types and styles. Having standardized monument, building, and directional signage
enhances the County's professional image and improves the ability of the general public to identify
and access County facilities and services. The Consultant is tasked with developing standard
exterior signage for the County. The Consultant's services include site surveys and analysis, design
and construction documents, and limited construction administration. Kate Keating Associates, Inc.
was selected through a competitive process conducted by the General Services Department and the
County Administratoes Office.

Development of the standard signage program will involve several County departments including the
County Administrator's Office. The Consultant will prepare schematic designs, which will be reviewed
by the County prior to establishing tate final design. It is anticipated that the initial "roll-out" of the new
signage will be implemented at approximately thirty County facilities. Thereafter, the signage will be
implemented incrementally. The installation work will be competitively bid and the construction
contract award will be the subject of a future Board Order.

1. APPROVE the Second Amendment to the Consulting Services Agreement dated March 6, 2001
with George Miers & Associates in the amount of $10,000, increasing', the payment limit from
$70,847 to $80,847 for the West Contra Costa County Animal Shelter, San Pablo Avenue and
Sunnyview Drive, Pinole.
2. AUTHORIZE the Director of General Services, or designee, to execute the Second Amendment
to the Consulting Services Agreement and to issue written authorizations for extra work, in
addition to the authorization for the Second Amendment, provided that the cumulative total cost
for all such authorizations shall not exceed $5,000.
FINANCIAL IMPACT
Funds are budgeted in the Plant Acquisition Fund to pay for the additional architectural services.
BACKGROUND
On March 4, 2001 the Board of Supervisors approved and authorized the Director of General
Services to execute a Consulting Services Agreement with George Miers & Associates to provide for
the build-out of shell space in a 5,050 square foot building at San Pablo Avenue and Sunnyview
Drive, Pinole to suit the requirements of the Animal Services Department.
The First Amendment increased the scope of services to provide for user requested revisions to the
building layout, modifications to the surrender and night drop cages, and additional construction
administration services to accommodate an extended project completion schedule.
The Second Amendment increases the scope of services to include investigation of masonry cracks,
additional responses to requests for information from the subcontractors, and extended construction
administration services. f�}

2. Purpose: On March G, 2001,the parties entered into a contract entitled "Consulting Services Agreement," referred to as the "Agreement," which
covers build out of shell space in a 5,050 square foot building to be constructed at San Pablo Avenue and Sunnyview Drive,Pinole for the Animal
Services Department. The Agreement has previously been amended as follows: First Amendment dated October 7, 2003. The parties desire to
further amend the Agreement to expand the scope of service and to increase the payment limit accordingly.

B. In accordance with Section 14 of the Agreement provide the following:

covers full design and construction observation services for a New Animal Control Facility in Martinez. The Agreement has previously been
amended as follows: First Amendment dated March 1, 2000, Second Amendment dated March 7,2001, Third Amendment dated September 11,
2001, Fourth Amendment dated September 6, 2001, Fifth Amendment dated October 8, 2001 and Sixth Amendment dated June 10, 2003. The
parties desire to further amend the Agreement to expand the scope of service and to increase the payment limit accordingly.
3. Amendments to A¢reemtent:
A. In the Agreement, Section I(c), change the Payment Limit from$664,368.00 to$702,368.00, an increase of$38,000.00. This change shall
apply to charges from and after August 1,2003.
B. In accordance with Section 14 of the Agreement provide the following:
Increase the scope of services to include extended construction services due to extensive project delays caused by the general contractor on
this project. Additional client requested services include an acoustic analysis of the sound walls isolating the dog wards,trench drain design
for the walk-in cooler, exterior wall height revisions, oxygen system design, eyewash station design, and a feasibility study for a pathogen
incinerator.
C. In Appendix B,paragraph F,increase the reimbursable limit from$15,940.00 to$35,940.00.
4. Effect:
Subject to the revisions made by this and any prior amendments,the Agreement shall remain in full force and effect.

The Third Amendment increased the scope of services to provide revised architectural drawings and
to develop additive alternate bid items to the plans and specifications to increase the capacity of the
facility.
The Fourth Amendment increased the scope of services to provide architectural and mechanical
design services for revisions to the Cat Adoption/Get Acquainted area.
The Fifth Amendment increased the scope of services to provide additional architectural renderings.
The Sixth Amendment increased the scope of services to design the build-out of three additional dog
wards.
The Seventh Amendment increases the scope of services to include extended construction services
due to extensive project delays caused by the general contractor on this project. To date,', the
General Services Department has received 13 stop notices from subcontractors, totaling
$1,138,190.97. While eight stop notices involving $701,127.24 have now been resolved, the project
is 110 days behind schedule. Estimated completion of the Shelter is April 26, 2004, but that date is
contingent on contractor performance. The Seventh Amendment includes additional client requested
services such as an acoustic analysis of the sound walls isolating the dog wards, trench drain design
for the walk-in cooler, emergency exit graphics, exterior wall height revisions, oxygen system design,
eyewash station design, a feasibility study for a pathogen incinerator, and associated reimbursables.

I. Recommended Action:
APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract amendment
with Blankinship and Associates,Inc.for the Aquatic Pesticides National Pollutant Discharge Elimination
System (NPDES) Monitoring Project Countywide to amend the Scope of Services effective February 1,
2004, and to extend the contract through January 31, 2005. (County Watershed Program Funds) (All
Districts).

III. Reasons for Recommendations and BackLyround:
Contra Costa County entered into an agreement with Blankinship and Associates,Inc.,on March 4,2003,to
prepare an East Bay Regional Pesticide Monitoring Program(RPMP)for the Statewide Emergency NPDES
Permit for discharges of aquatic pesticides. The Scope of Services is being amended to include additional
tasks of annual report writing,submittal of annual reports to the State Water Resources Control Board,the
San Francisco Regional Water Quality Control Board and the Central 'Valley Regional Water Quality
Control Board on or before January 31,2005,provide electronic copy and hard copy of annual reports to
Contra Costa County,provide analytical laboratory coordination/management,conduct field sampling,and
reconnaissance for the RPMP permit compliance measures.The existing contract terminates on January 31,
2004;extension of the Agreement to January 31,2005,will allow Blankinship and Associates to establish
procedures to be carried on by County staff in the future.
IV. Consequences of Negative Action:
If the contract amendment is not approved with Blankinship and Associates, Inc., the County will not
benefit from the extensive background acquired by the consultant during development of the County's
Emergency NPDES Permits and may have difficulty complying with the Statewide General National
Pollutant Discharge Elimination System(NPDES)permit. Since Blankinship and Associates assisted the
County in developing and implementing the Emergency Permit, it will be most efficient to use the same
consultant to implement the first amendment to that permit.
